AN ORDINANCE appropriating $740,700.00 from the undesignated fund balance of the 2014 Special Road and Bridge Fund, in acceptance of funds from the City of Kansas City, Missouri, authorizing the County Executive to execute an Amendment No. 1 to the Cooperative Agreement with the City, and authorizing the Director of Finance and Purchasing to issue a payment in the amount of $1,021,522.00 to the Missouri Highways and Transportation Commission, in connection with the Lee's Summit Road Improvements, Anderson Drive to U.S. 40 Highway, Project No. 3122.

Body
WHEREAS, Jackson County, the City of Kansas City, the City of Lee's Summit, and the Missouri Highways and Transportation Commission (MHTC) have all undertaken plans for the Lee's Summit Road Improvements, Anderson Drive to U.S. 40 Highway, Project No. 3122; and,
WHEREAS, this project has been allocated Federal STP (Surface Transportation Program) Funds under the Federal Aid Project, Contract No. STP-3301(454); and,
WHEREAS, by Resolution 18146, dated April 8, 2013, the Legislature did authorize the execution of a Cooperative Agreement between Jackson County and the City of Kansas City, MO, ("City") for the design and construction of water main relocations and upgrades in association with the Lee's Summit Road Project, No. 3122; and,
WHEREAS, by Ordinance 4610, dated March 10, 2014, the Legislature did authorize the execution of a Cost Apportionment Agreement between Jackson County and the Missouri Highways and Transportation Commission, which provided for MHTC to bid the project and match funds from Jackson County and the City of Kansas City funds passed through Jackson County to MHTC; and,
WHEREAS, estimates for the water main relocation project have exceeded the amount that was anticipated and a payment will be due to the MHTC to cover these additional costs; and,
WHEREAS, the City has requested the execution of Amendment No. 1 to its Cooperative Agreement with the County for additional costs associated with the design and construction of water main relocations and upgrades portion of this project; and,
WHEREAS, pursuant to the contract amendment, the City will submit a payment to the County for its portion of the additional amount due for this work; and,
WHEREAS, an appropriation is necessary to place the City funds in the appropriate spending account; and,
WHEREAS, the County Executive recommends said appropriation; now therefore,
BE IT ORDAINED by the County Legislature of Jackson County, Missouri, that the following appropriation from the undesignated fund balance of the 2014 Special Road and Bridge Fund be and hereby is made:

BE IT FURTHER ORDAINED that the County Executive be and hereby is authorized to execute the attached Amendment No. 1 to the Cooperative Agreement with the City of Kansas City, Missouri; and,
BE IT FURTHER ORDAINED that the Director of Finance and Purchasing be and hereby is authorized to issue a check in the amount of $1,021,522.00 payable to the Missouri Highways and Transportation Commission for the Lee's Summit Road Improvements Project, No. 3122.
