Body
WHEREAS, by Resolution 17279, dated May 20, 2010, the Legislature did award twelve-month term and supply contracts for the furnishing of professional mortuary services to Marts Memorial Services of Kansas City (Jackson County), MO, to provide cremation services and Slider Funeral Home of Kansas City, KS, to provide burial services for individuals who die within the County and have no means of paying a funeral expense; and,
WHEREAS, the Missouri Board of Embalmers and Funeral Directors has revoked the license for Marts Memorial Services and the 16th Circuit Court has upheld that revocation, effective March 11, 2011; and,
WHEREAS, the second lowest bidder on Request for Proposal 6-09 has declined to accept the remainder of the contract for cremation services; and,
WHEREAS, the Director of Finance and Purchasing recommends the re-award of the cremation services contract to Charter Funeral Home, of Grandview, MO, as the third lowest cost proposal for cremation services received under RFP No. 6-09; now therefore,
BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the portion of Resolution 17279, dated May 20, 2010, awarding a contract for the furnishing of cremation services to Marts Memorial Services of Kansas City, MO, is hereby rescinded; and,
BE IT FURTHER RESOLVED that award be made as recommended by the Director of Finance and Purchasing and that the Director be, and is hereby, authorized to execute for the County any documents necessary for the accomplishment of the award; and,
BE IT FURTHER RESOLVED that the Director of Finance and Purchasing be and hereby is authorized to make all payments, including final payment on the contract, to the extent that sufficient appropriations to the using spending agency have been made in the then current Jackson County budget.

Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
