A RESOLUTION transferring $31,480.00 within the 2003 General Fund and awarding a contract for the furnishing and maintenance of software for use by the Jackson County Board of Election Commissioners to Votec Corporation of San Diego, CA, at a cost to the County not to exceed $31,480.00, as a sole source purchase.

Body
WHEREAS, Section 1040.1 of the Jackson County Code, 1984, eliminates the requirement for competitive bidding when items to be purchased can be obtained from only one source; and,
WHEREAS, Section 1063.00 of the Code requires notification of and approval by the Legislature on such sole source purchases exceeding $5,000.00; and,
WHEREAS, the Purchasing Director recommends a contract with Votec Corporation of San Diego, CA, for the furnishing and maintenance of software for use by the Jackson County Board of Election Commissioners; and,
WHEREAS, the Purchasing Director further recommends that it not take competitive bids with regard to said contract for the reason that Votec Corporation of San Diego, CA is the only supplier of maintenance of its own proprietary software used by the board; and,
WHEREAS, a transfer within the 2003 General Fund is necessary to cover this purchase; and,
WHEREAS, the County Executive has recommended said transfer; therefore,
BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the following transfer be made within the 2003 General Fund:
