Body
WHEREAS, Section 1040.1 of the Jackson County Code, 1984, eliminates the requirement for competitive bidding when items to be purchased can be obtained from only one source; and,
WHEREAS, Section 1063.00 of the Code requires notification of and approval by the Legislature on such sole source purchases exceeding $5,000.00; and,
WHEREAS, the Purchasing Director recommends a contract with Borland Software Corporation of Scotts Valley, CA, for the furnishing of onsite training on Delphi software application for use by the MIS Department; and,
WHEREAS, the Purchasing Director further recommends that he not take competitive bids with regard to said contract for the reason that Borland Software Corporation of Scotts Valley, CA, is the only known supplier of onsite training for its proprietary Delphi software; therefore,
BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that award be made as recommended by the Purchasing Director, and that the Purchasing Director be, and is hereby, authorized to execute for the County a contract with Borland Software Corporation of Scotts Valley, CA, as recommended by the Purchasing Director; and,
BE IT FURTHER RESOLVED that the Director of the Department of Finance is authorized to make all payments, including final payment on the contract.
Enacted and Approved
Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
