WHEREAS, a recent opinion of the Missouri Attorney General, has determined that the Director of Collections lacks the authority to waive penalties and interest accruing on any delinquent property tax account unless that authority is otherwise granted by federal or state law or the County's Charter or code; and,
WHEREAS, the Legislature has determined that it is in the best interests of the health, welfare, and safety of the citizens of Jackson County that the Legislature include such a proscription in the County Code; now therefore,
BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:
Section A. Enacting Clause. Section 2129., Jackson County Code, 1984, is hereby enacted to read as follows:
2129. Penalties and Interest, Waiver.
No county official shall waive any portion of any statutory penalty or interest due on any delinquent tax account unless pursuant to sections 2050. - 2056. of this code, or as authorized by federal or state law.
Enacted and Approved
Effective Date: This ordinance shall be effective immediately upon its signature by the County Executive.
