County Legislators
WHEREAS, with the average working woman again making only 76 cents for every dollar the average working man makes in a virtually identical job, lawmakers, the AFL-CIO, and womens' groups are again pushing equal pay legislation; and,
WHEREAS, the Equal Pay Act of 1963 (EPA, 29 U.S.C. ยงยง206 et seq.), which is part of the Fair Labor Standards Act of 1938, as amended (FLSA), and which is administered and enforced by the Equal Employment Opportunity Commission, prohibits sex-based wage discrimination between men and women in the same establishment who are performing under similar working conditions; and,
WHEREAS, additionally, the Equal Pay Act of 1963, prohibits discrimination on account of sex in the payment of wages by employers engaged in commerce or in the production of goods for commerce; and,
WHEREAS, two items of current legislation introduced by Reps. Rosa DeLauro (D-Conn.), Eleanor Holmes Norton (D-D.C.), and Sen. Tom Harkin (D-Iowa), "would put teeth in this 41-year-old equal pay law, now on the books," said Rep. DeLauro; and,
WHEREAS, Rep. DeLauro's bill would allow women to recover punitive damages for violations of the EPA, not just back wages and compensation; and,
WHEREAS, Rep. Norton's "Fair Pay Act" bill would enforce equal pay for working women with the same skills, effort, and responsibilities as working men, and elevate pay discrimination based on gender to the same status as pay discrimination based on race, invoking the Civil Rights Acts; and,
