A RESOLUTION authorizing the County Executive to execute a waiver of any interest in certain funds held by the Jackson County Land Trust.

Body
WHEREAS, the Jackson County Land Trust ("Land Trust") is an independent agency charged with taking properties which have been forfeited for failure to pay taxes, marketing said properties for resale, refunding excess sale proceeds to the taxing jurisdictions within the county, and placing the properties back on the tax rolls; and,

WHEREAS, the Land Trust is currently in possession of Three Hundred Thousand Dollars ($300,000.00) from proceeds from the past property sales ("Sale Proceeds") for which the Land Trust is unable to identify the source; and,

WHEREAS, the Land Trust has requested that all taxing jurisdictions in the County, including the County itself, waive their interest in the Sale Proceeds, which waiver will not waive the County's interest in the proceeds of any future Land Trust sales; and,

WHEREAS, the Legislature has determined that waiving the County's interest in the Sale Proceeds is in the best interests of the health, welfare, and safety, of the citizens of Jackson County; therefore,

BE IT RESOLVED, by the County Legislature of Jackson County, Missouri, that the County Executive is hereby authorized to execute a Waiver of Any Interests to Funds Held by the Jackson County Land Trust, in a form approved by the County Counselor; and,

BE IT FURTHER RESOLVED that this Resolution shall be effective only upon the adoption of a functionally equivalent Resolution by the Board of Education of the Kansas City, Missouri School District.

Fiscal Note
Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
