A RESOLUTION in support of a request for copies of records of the Kansas-Missouri Bi-State Metropolitan Culture District Commission under the Missouri Open Records Act.

Body

WHEREAS, the Legislative Auditor has released a report concerning the finances of the Kansas-Missouri Bi-State Metropolitan Culture District Commission; and,

 

WHEREAS, that report is now the subject of an inquiry by the Legislature's Finance and Audit Committee; and,

 

WHEREAS, the commission, created by the legislatures of the States of Kansas and Missouri and approved by the United States Congress, was charged with administering a sales tax for the rehabilitation and expansion of Union Station, authorized by the voters of Clay, Jackson, and Platte Counties in Missouri, and Johnson County in Kansas, in November 1996; and,

 

WHEREAS, the tax authorized by the voters was capped by its ballot language, at a maximum of $118 million; and,

 

WHEREAS, the Legislative Auditor has advised that the tax proceeds actually received by the commission exceeded the $118 million ballot language cap by more than $3 million; and,

 

WHEREAS, the commission's counsel has advised the chair of the Finance and Audit Committee that the commission has received legal advice to the effect that the commission is entitled to retain these excess proceeds, despite the express provisions of the ballot language; and,

 

WHEREAS, the chair of the Finance and Audit Committee has requested, pursuant to the Missouri Open Records Act, copies of any legal opinions the commission has received on this issue, as well as the minutes or journals of the meetings of the commission and its finance committee over the past twelve months, at which this issue may have been discussed; and,

 

WHEREAS, the county would be responsible for all costs of reproduction of materials associated with this request; and,

 

WHEREAS, it is appropriate that the Finance and Audit Committee be allowed to review these materials in connection with its consideration of the Legislative Auditor's report; now therefore,

 

BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the Legislature supports the Missouri Open Records Act request of the chair of the Finance and Audit Committee to the Kansas-Missouri Bi-State Metropolitan Culture District Commission.

 

Enacted and Approved

Effective Date:  This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
