Body

 WHEREAS, some County-owned buildings use proprietary HVAC systems from Johnson Controls, Inc., of Lenexa, KS, and the parts and services for these systems can only be provided by Johnson Controls, Inc.; and,

 

WHEREAS, Resolution 21449, passed November 6, 2023, awarded a term and supply contract to Johnson Controls, Inc., of Lenexa, KS under Sourcewell Contract No. 070121-JHN; and,

 

WHEREAS, a new Sourcewell Contract, No. 080824-JHN, has been bid and put in place with more favorable terms for the acquisition of necessary HVAC parts and services; and,

 

WHEREAS, the Facilities Management Division of the Public Works Department has a need to change the government contract for HVAC parts and services; and,

 

WHEREAS, pursuant to section 1030.4, Jackson County Code, the Director of Finance and Purchasing recommends the award of a thirty-nine-month term and supply contract with three twelve month options to extend for the furnishing of HVAC parts and services to Johnson Controls, Inc. of Lenexa, KS, under the terms and conditions of Sourcewell Contract No. 080824-JHN, an existing competitively bid government contract; and,

 

WHEREAS, the Director of Finance and Purchasing recommends award to Johnson Controls of Lenexa, KS, under the existing government contract due to the higher volume discounts and wider availability of items offered to larger entities; and,

 

WHEREAS, this award is made on an as needed basis and does not obligate the County to pay any specific amount; now therefore,

 

BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that award be made as recommended by the Director of Finance and Purchasing and that the Director be and hereby is authorized to execute for the County any documents necessary to the accomplishment of the award; and,

 

BE IT FURTHER RESOLVED that the Director of Finance and Purchasing is authorized to make all payments, including final payment on the contract, to the extent that sufficient appropriations to the using spending agency are contained in the then current Jackson County budget.

 

 

Enacted and Approved

Effective Date:  This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
