A RESOLUTION authorizing the County Executive to execute an Intergovernmental Agreement with the City of Kansas City, Missouri, relating to the funding of an AIDS case manager at the Jackson County Health Department.

Body

WHEREAS, in accordance with section 2602(b)(1) of the Public health Services Act as amended by the Ryan White Comprehensive AIDS Resource Emergency Act of 1990, Public Law 101-381, dated August 18, 1990, 104 Stat. 576, the chief elected official of the city or county with the largest number of reported AIDS cases that provides HIV Health Care Services within an eligible metropolitan area (EMA) is designated to receive federal funding for the purpose of delivering or enhancing HIV-related services; and,

 

WHEREAS, the greater Kansas City Metropolitan area has been designated an EMA by virtue of having over 2,000 reported AIDS cases as of March 31, 1993 as confirmed by the Director of the Center for Disease Control; and,

 

WHEREAS, the Kansas City EMA includes Ray, Clay, Cass, Platte, Lafayette, Jackson, and Clinton Counties in Missouri and Miami, Wyandotte, Leavenworth, and Johnson Counties in Kansas; and,

 

WHEREAS, the Kansas City EMA has been designated as a Ryan White Title I City and Kansas City, Missouri has been designated to receive federal funding; and,

 

WHEREAS, the Ryan White Comprehensive Aids Resources (CARE) Act of 1990, requires that intergovernmental agreements (IGA) be established between the chief elected officials of political subdivisions which have not less than ten percent (10%) of the reported AIDS cases in the EMA; and,

 

WHEREAS, Jackson County has over ten percent (10%) of the reported AIDS cases in the Kansas City EMA as March 31, 1993, and 8.5% of the reported Aids cases in the Kansas City EMA excluding residents of Kansas City, Missouri; and,

 

WHEREAS, the Jackson County Health Department is a provider of HIV counseling and testing services; and,

 

WHEREAS, the City of Kansas City, Missouri Health Department is a provider of HIV services; and,

 

WHEREAS, Jackson County residents who are residents of Kansas City, Missouri, are tested at the Kansas City health Department or at subcontracted sites; and,

 

WHEREAS, the Jackson County Health Department refers persons testing positive for HIV antibodies to Truman Medical Center for primary care; and,

 

WHEREAS, Kansas City, Missouri residents, and Jackson County residents can access primary medical care at Truman Medical Center; and,

 

WHEREAS, Truman Medical Center-East and Truman medical Center-West are subcontractors funded under Ryan White Title III; and,

 

WHEREAS, Truman Medical Center is an eligible vendor to provide primary medical care under Ryan White I vendor participation services delivery model; and,

 

WHEREAS, 14 of the 20 members of the steering committee are residents of Jackson County; and,

 

WHEREAS, 5 of the steering committee members are minority, and all 5 of these individuals are residents of Jackson County; and,

 

WHEREAS, the attached Intergovernmental Agreement sets forth the agreement and understanding of the parties; therefore,

 

BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the County Executive be and hereby is authorized to execute the attached Intergovernmental Agreement with the City of Kansas City, Missouri.

 

Enacted and Approved

Effective Date:  This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
