BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:

 

Section A.  Enacting Clause.   Sections 9303., Jackson County Code, 1984, is hereby repealed, and one new section enacted in lieu thereof, to be known as section 9303., to read as follows:

 

9303.  Annual Appropriations, Guidelines.

                     9303.1  Prosecution and Incarceration.

Each year not less than 50% of the proceeds of the anti-drug sales tax shall be appropriated for the arrest, prosecution, and incarceration of those accused of drug related offenses.

 

9303.2     Annual Proceeds, Specific Allocation.

Each year, the annual proceeds of the anti-drug sales tax shall be appropriated and allocated among the various anti-drug initiatives, according to the following percentages:

Any portion of the appropriated funds that remain unspent at the end of a budget year, as demonstrated by the annual audit, shall be reappropriated to the same initiative in the budget year immediately following the audit, but shall be subject to allocation among any of the agencies participating in the initiative concerned.

 

9303.3    Surplus Funds, Specific Allocation.

Any surplus funds that remain unspent at the end of a budget year, as demonstrated by the annual audit, shall be appropriated to the various initiatives according to the percentages set out in subsection 2 of this section, in the budget year immediately following the audit.

 

Enacted and Approved

Effective Date:  This ordinance shall be effective immediately upon its signature by the County Executive.
