IN THE COUNTY LEGISLATURE OF JACKSON COUNTY, MISSOURI Title A RESOLUTION opposing the rezoning of a 12-acre site at the Southeast Landfill in Kansas City for a proposed solid waste transfer station. Intro RESOLUTION # 12626, March 29, 1999 INTRODUCED BY Ronald E. Finley, County Legislator Body WHEREAS, the Southeast Landfill, located at 83rd and Indiana in Kansas City, was originally permitted in 1974, and was re-permitted in 1980, 1983, 1988, and 1992, at which time a closing date of January 1, 1996, was agreed upon by its operator, Laidlaw Waste Systems; and, WHEREAS, in 1993, a new owner, Allied Waste Systems, circumvented the agreement to close the landfill and received an additional extension to a new April 1, 1999 closing date; and, WHEREAS, in the Fall of 1988, Allied requested still another five-year extension to continue to develop and operate the last landfill cell to completion, but withdrew this application in the face of significant neighborhood opposition; and, WHEREAS, Allied has now made a request to the City of Kansas City Development Department to rezone a 12-acre site at the Southeast Landfill to operate a solid waste transfer station; and, WHEREAS, the location of the proposed transfer station is near the East Meyer, NOBLE, Gregory Ridge, and Marlborough East neighborhoods; and, WHEREAS, the East Meyer Community Association held a public meeting on February 23, 1999, at which the issue was presented before a large group of East Meyer and community residents and the community responded that it did not want the landfill to remain open in any form, including a transfer station; and, WHEREAS, the East Meyer, NOBLE, Gregory Ridge, and Marlborough East neighborhoods all lie in close proximity to the 12-acre site and oppose the rezoning request and the operation of a transfer station, insisting that the Southeast Landfill should close as scheduled on April 1, 1999, and cease any operations except those required by the EPA to monitor and maintain the landfill; and, WHEREAS, due to its close proximity to residential areas in the City, the continued operation of this landfill is not in the best interests of the health, welfare and safety of the citizens of Jackson County; now therefore, BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the Legislature opposes the rezoning of a 12-acre site at the Southeast Landfill for a proposed solid waste transfer station. Attorney Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
