AN ORDINANCE exempting from the provisions of the Section 99.915 et seq, Revised Statutes of Missouri, as amended a county-wide sales tax in the amount of one quarter cent in the Kansas and Missouri metropolitan culture district for the renovation of the Truman Sports Complex and enhancement of cultural facilities, organizations, and activities.

WHEREAS, the State legislature has established the Downtown Economic Stimulus Act (MODESA) by adoption of Sections 99.915, et seq, Revised Statutes of Missouri, as amended (RSMo) for the purpose of providing additional incentives to redevelopment within the downtown areas of certain local governmental units; and,

 

WHEREAS, the City of Kansas City, Missouri, has filed its application for approval under MODESA to encourage redevelopment efforts in its downtown area; and,

 

WHEREAS, certain local taxes may be subject to the terms of MODESA in their use to encourage redevelopment projects although those same taxes are excluded in local tax increment financing projects; and,

 

WHEREAS, Section 99.957 (4), RSMo, provides that a county may exclude certain local, county-wide taxes from inclusion in the general tax provisions of MODESA; and,

 

WHEREAS, by ORDINANCE # 3510, passed June 28, 2004, the Jackson County Legislature did propose to submit to the voters of Jackson County at a general election held on November 2, 2004, the levy of a retailers' sales tax in the amount of one-fourth (1/4) of one cent (.25%), as part of the BiState Metropolitan District, authorized for and within Jackson County, Missouri; and,

 

WHEREAS, the proceeds of the retail sales tax, if approved by the voters, would be devoted to certain to support renovations to Kauffman and Arrowhead Stadiums and to provide financial assistance to metropolitan and local arts and cultural facilities, organizations, and activities including construction of the Metropolitan Kansas City Performing Arts Center; and,

 

WHEREAS, it is in the intent of this legislature that the full proceeds from the BiState retail sales tax submitted to the voters of Jackson County Pursuant to Ordinance #3510 passed by this legislature on June 28, 2004, if approved, be used for the specific purposes of the BiState Metropolitan District; now therefore,

 

 

BE IT ORDAINED by the County Legislature of Jackson County, Missouri, as follows:

 

Section 1.                       Pursuant to Section 99.957(4) RSMo, Jackson County hereby exempts from the provisions of Sections 99.915, et. seq., RSMo commonly known as the Missouri Downtown Economic Stimulus Act (MODESA) and such statutory provisions relating to Tax Increment Financing Districts within Jackson County, the proceeds of the county-wide sales tax submitted to the voters pursuant to Ordinance #3510 which would become binding and effective April 1, 2005, if approved by the voters of the County on the November 2, 2004, and subject to approval of the qualified voters in Clay County, Missouri, and in Johnson County, Kansas,  based on a levy of a retailers' sales tax in the amount of one-fourth (1/4) of one cent (.25%), as part of the BiState Metropolitan District.

 

Section 2.  This Ordinance shall be published as required by law.

 

Section 3                     The Clerk of the Legislature is hereby authorized and directed to notify the appropriate collection authorities, including the City of Kansas City, of the exemption under this Ordinance.

 

 

Enacted and Approved

Effective Date:  This Ordinance shall be effective immediately upon its signature by the County Executive.
