AN ORDINANCE reappropriating $40,000.00 from the unappropriated surplus of the 2002 Homeless Assistance Fund, partially rescinding Resolution 13399, dated October 23, 2000, and Resolution 13944, dated December 10, 2001, and authorizing the County Executive to execute an Agreement with Legal Aid of Western Missouri, to provide assistance to homeless persons, at a cost to the County not to exceed $82,800.00.

Body
WHEREAS, by Resolution 13399, dated October 23, 2000, the Legislature did authorize the County Executive to execute agreements with certain agencies which provide assistance to homeless persons, at an aggregate cost to the county not to exceed $557,556.00 in calendar year 2001; and,
WHEREAS, by Resolution 13944, dated December 10, 2001, the Legislature did authorize the County Executive to execute agreements with certain agencies which provide assistance to homeless persons, at an aggregate cost to the county not to exceed $605,033.00 in calendar year 2002; and,
WHEREAS, included within these Resolutions was authorization for agreements with Legal Aid of Western Missouri for its program providing free legal services to those in danger of becoming homeless, in an amount not to exceed $40,000.00 for 2001, and $42,280.00 for 2002; and,
WHEREAS, due to a breakdown in communications between Legal Aid and County staffs, the Agreement for 2001 was never executed; and,
WHEREAS, it is appropriate that the previously authorized funding for 2001 and 2002 be combined into one two-year agreement covering both calendar years; and,
WHEREAS, at its meeting of February 28, 2002, the Housing Resources Commission recommended this course of action; and,
WHEREAS, the attached Agreement provides a suitable mechanism by which to implement this new agreement and understanding of the parties; and,
WHEREAS, in order to fund this agreement a reappropriation a reappropriation of the unused 2001 funds is necessary; and,
WHEREAS, the County Executive recommends this reappropriation as an amendment to her proposed 2002 annual County budget; now therefore,
BE IT ORDAINED by the County Legislature of Jackson County, Missouri, that the following reappropriation be made from the unappropriated surplus of the 2002 Homeless Assistance Fund:

BE IT FURTHER ORDAINED that those portions of Resolution 13399, dated October 23, 2000, and Resolution 13944, dated December 10, 2001, authorizing funding for Legal Aid of Western Missouri be and hereby are rescinded; and,
BE IT FURTHER ORDAINED that the County Executive be and hereby is authorized to execute the attached Agreement with Legal Aid of Western Missouri; and.
BE IT FURTHER ORDAINED that the Manager of the Division of Finance be and hereby is authorized to make all payments including final payment on the Agreement.

Effective Date: This ordinance shall be effective immediately upon its signature by the County Executive.
