Title
A RESOLUTION awarding a contract for the furnishing of on-line legal research services for use by the County Counselor's Office ($7,860.00 annually, $2,620.00 for 2004), and SmartLinx research services for use by the Collection Department ($10,080.00 annually, $3,360.00 for 2004), to LexisNexis of Dayton, OH, at an actual cost to the County not to exceed $17,940.00 annually, $5,980.00 for 2004, as a sole source purchase.

Body
WHEREAS, Section 1040.1 of the Jackson County Code, 1984, eliminates the requirement for competitive bidding when items to be purchased can be obtained from only one source; and,
WHEREAS, Section 1063.00 of the Code requires notification of and approval by the Legislature on such sole source purchases exceeding $5,000.00; and,
WHEREAS, the Purchasing Director recommends a contract with LexisNexis of Dayton, OH, for the furnishing of on-line legal research services for use by the County Counselor's Office and SmartLinx research services for use by the Collection Department; and,
WHEREAS, the Purchasing Director further recommends that he not take competitive bids with regard to said contract for the reason that LexisNexis of Dayton, OH, is the only known supplier of its own proprietary SmartLinx and legal research services; therefore,
BE IT RESOLVED that award be made as recommended by the Purchasing Director, and that the Purchasing Director be, and is hereby, authorized to execute for the County a contract with LexisNexis of Dayton, OH; and,
BE IT FURTHER RESOLVED that the Director of the Department of Finance is authorized to make all payments including final payment on the contract.

Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
