A motion was made by Tony Miller, seconded by Jalen Anderson to adopt  
Ordinance 5656.  
Dan Tarwater III objected to the passage of Ordinance #5656.  
Jalen Anderson, County Legislator, said this measure came about  
because the Missouri Legislature enacted a ban on abortion without  
allowing input from the citizens of the state. This question will allow the  
community to vote to express their opinion about whether the abortion ban  
should be repealed or kept. The County Legislature has a history of these  
types of referendums, such as when the County voted to keep the Andrew  
Jackson statue. As the second largest county in the State of Missouri, our  
citizens should have the right to state their opinion. Mr. Anderson said, in  
his opinion, allowing the voters voices to be heard is the morally right thing  
to do. In Kansas for example, 59% of the voters said the government  
should not have control over a woman’s body. This is a vote for liberty and  
freedom. Although this ballot measure will not change state law, Mr.  
Anderson said he calls on his fellow Legislators to consider allowing our  
community to have a say on this issue.  
Tony Miller, County Legislator, said his vote to allow this on the ballot is  
because he believes his wife, his daughters, and other women should  
have personal autonomy over their own bodies. This will allow the people  
of Jackson County to have a say.  
Ronald E. Finley, County Legislator, asked Mary Jo Spino, County Clerk,  
if this is adopted today, will there be enough time to get this on the  
November ballot. Ms. Spino said yes, the certified ballot is ready to go  
either way.  
Jeanie Lauer, County Legislator, said she sees two different issues – one  
is the discussion about abortion and the other is the ballot language, which  
is a question asking people to state their opinion. She has had calls from  
constituents confused about what this means. Some believe it will change  
the state law, some believe it will allow abortion in Jackson County, and  
some people believe this will be a statewide vote on the issue. It is  
misleading to voters and creates confusion because people are not clear  
on what the vote means.  
Crystal Williams, County Legislator, said this Ordinance is based on what  
other municipalities are doing in cases in which they feel they are held  
hostage by actions in their state. Many medical providers are terrified of  
losing their medical license if they make a wrong step. Numerous people  
have asked for guidance on how to proceed. The State Legislators have  
blasted us back to the 1950s. If voters do not understand what we are  
voting on, we have time to educate them on the question. If we do nothing,  
people may die.  
Dan Tarwater III, County Legislator, said he would not be opposed to  
having this question on a statewide ballot. But this question gives people a  
false sense of hope because this question does nothing to change the law.  
Theresa Cass Galvin, County Legislator, said the difference between this  
question and the Andrew Jackson statue vote, is the voters could actually  
make a difference in their vote on the statue. But the abortion question is a  
state issue. Many people may vote yes, but that vote will do nothing to  
change any law and will create unnecessary emotions. It is unfair to voters  
because it is misleading the way it is written. Ms. Galvin said she has  
reached out to contacts on the state level asking them to address these  
issues.  
Jalen Anderson said the reason for this ordinance is because the  
Supreme Court decided 50 years ago to give women the right to choose.  
So now we have a Supreme Court saying that the states may make their  
own laws. He said he had heard from constituents that have had to go out  
of state for medical care when an expectant woman has found her life at  
risk because of a pregnancy and medical providers who are concerned  
about losing their license. We need to expect that state officials will call the  
sheriff to arrest a Missouri resident that has gone to Kansas or Illinois for  
an abortion. Our state legislature is not listening to its people. It is state  
overreach. It will be harder to get measures on the ballot in the future and  
they will come after you if you cross state lines. Is this the kind of  
government we want?  
Tony Miller moved the passage of Ordinance #5656 as perfected,  
submitting to the qualified voters of Jackson County, Missouri, at the general  
election to be held on November 8, 2022, an advisory referendum question  
asking whether section 188.017 of the Revised Statutes of Missouri, which  
bans abortion at any stage of pregnancy without exception for rape or incest,  
should be repealed to ensure safe and legal access to abortion. Seconded  
by Jalen Anderson.

COUNTY EXECUTIVE ORDERS

NEW BUSINESS  
Ronald E. Finley said the Administration has posted a request for proposals  
to provide $3 million in American Rescue Plan Act funding to support  
infrastructure costs for health center construction, expansion, alteration,  
renovation, and other capital improvements. This opportunity will allow health  
care centers to expand their infrastructure to improve access for the health  
care needs in the community. Bids may be submitted through the County’s  
web portal through September 20, 2022. This is for the betterment of the  
men, women and children of Jackson County.  
Dan Tarwater III asked for an update on the status of the pension study.  
Michelle Chrisman, Director of Human Resources, said they received  
questions from the providers, and they expect this study will take two to three  
more weeks. Mr. Tarwater said, this study is to move all associates of  
Jackson County from 1.5% to 2% and sworn personnel to 2.5% with a  
10-year vesting period. Mr. Tarwater asked if there is an actuarial study on  
the status of the plan. Ms. Chrisman said the most recent study is in the 90s.  
He asked about some pay raises from the Sheriff’s office. Jay Haden, Chief  
Deputy County Counselor, said the only issue he is aware of is the creation  
of a new under sheriff position at the Sheriff’s Office. Troy Schulte, County  
Administrator, said he believes this is still under negotiation with the  
Sheriff’s Office.

The County Legislature will NOT meet the week of September 5th due to  
the Labor Day Holiday.
