THE PLEDGE OF ALLEGIANCE

APPROVAL OF THE JOURNAL OF THE PREVIOUS MEETING  
A motion was made by Jeanie Lauer, seconded by Manuel Abarca IV to  
approve the journal of the previous meeting held on October 02, 2023. The  
motion passed by a voice vote.

HEARINGS  
Resolutions #21418, #21423, #21424, #21425, #21428, and #21422 were  
adopted at this time. See pages 5 through 7 for details.  
Colleen White, Strategic Workplace Solutions, Inc. (SWS), and David  
Kirkpatrick, Kirkway Investments LLC, presented an update regarding  
compliance oversight for the Detention Center Project. Ms. White introduced  
herself. She has been in business in the Kansas City area for 17 years on  
prevailing wage, minority workforce, and women’s workforce matters. She  
and her team, David Kirkpatrick, and Gayle Holliday had met with the  
previous Legislature and were chosen for compliance oversight on the  
Detention Center Project. The project is just getting started. They have met  
with the professional design teams working with J.E. Dunn-Axiom. They are  
keeping compliance oversight on J.E. Dunn and the workforce with which it  
contracts. SWS is coordinating its work with Melinda Bolling, the Chief  
Compliance Officer for the County. SWS sends a monthly report to Ms.  
Bolling, who forwards the information to the Legislature. Ms. White said she  
was involved in the development of the County’s prevailing wage, WBE and  
MBE programs. There are three areas they will watch: 1) Funding that is  
spent on the minority (17% goal), women (11% goal), and veterans (.05%  
goal) business owners that have contracts on this project. 2) They are  
watching the workforce goals, which is a 35% goal, and 3) they monitor  
prevailing wage compliance. There is minor prevailing wage work being  
done so far. This part of the project will gear up in November and  
December. SWS watches to make sure the workers are being classified  
and paid properly. They make sure no one is doing pass-through work,  
where they claim they are performing the work, but they hire someone else  
to do the work. The problems SWS typically finds are in the lower-tiered  
subs. David Kirkpatrick will conduct site visits and interview the workers on  
a regular basis. The workers on-site may tell SWS information that is not  
reflected on the filed paperwork. Mr. Kirkpatrick said he worked as a  
business manager for Local 518, Plasterers and Cement Masons Union. In  
that role he did similar work to ensure workers were treated fairly.  
Jeanie Lauer, County Legislator, asked what are some of the things that are  
going well on the project? Ms. White said there is not a lot going on, but the  
reporting has been timely and accurate. Ms. Lauer asked what things might  
not be going as smoothly? Ms. White said there are always issues with  
prevailing wage and classification problems. She normally wants to dig  
deeper into the fringe benefits. Other issues that may come up are paying  
apprenticeship wages, which has its own compliance issues, including  
registration with a training program with the U.S. Department of Labor. They  
also watch out for pass-through issues by hiring subs to do the work. Jeanie  
Lauer asked about measures put in place. Ms. White said the contractors  
have to be certified. Her team will double check all of the vendors - the prime  
contractor and the subcontractors.  
Manuel Abarca IV, County Legislator, asked about situations with no  
compliance monitoring. Ms. White said most problems are found on the job  
site. The LCPtracker software system might flag some problems. But talking  
to workers onsite makes the difference. It is comparable to a quality control  
system. Compliance is a lot of work, and a full staff is needed.  
Mr. Abarca asked the Administration for a status update on the process to  
approve the open compliance positions. Caleb Clifford, Chief of Staff, said  
he had no information but will look into the matter this week.

COMMUNICATIONS WITH AND REPORTS OF THE COUNTY EXECUTIVE  
Caleb Clifford said there was no report. The County Executive was not  
present.  
Manuel Abarca IV asked about issues with an inappropriate email being  
sent out executive distribution and problems in the Information Technology  
Department. Mr. Clifford said he had no information on the matter. Mr.  
Clifford said he would be happy to have the IT Director speak to the County  
Legislature about it.  
Mr. Abarca said he has reports that the Assessment Department modified  
the values of some properties after the value was certified, without notifying  
the property owners. Mr. Clifford said he will ask the Assessment  
Department to address the questions. Bryan Covinsky, County Counselor,  
said he is not aware of this issue. Mr. Abarca said the constituent has an  
image of the value that was certified. He did not appeal. He also has an  
image of the changed value online that is different than value on the notice  
he received in the mail. The Assessment Department acknowledged the  
change and claimed they had sent a notice of the change, but when he  
looked again, the value was changed back to the original value in the  
original notice. Mr. Abarca asked how this occurs and why did this occur.  
Caleb Clifford requested more information so the issue can be investigated.  
Mr. Abarca said he is frustrated with the standard answer "We will look into  
it." with no follow up.

PERFECTION OF PROPOSED ORDINANCES AND REPORTS OF COMMITTEE  
AN ORDINANCE appropriating $110,000.00 from the undesignated fund  
balance of the 2023 Assessment Fund to cover the cost of salaries and  
overtime for the remainder of the 2023 Board of Equalization (BOE)  
appeals docket.

AN ORDINANCE repealing sections 9103. and 9104., Jackson County  
Code, 1984, relating to the Board of Equalization, and enacting, in lieu  
thereof, two new sections relating to the same subject.

AN ORDINANCE appropriating $16,748.00 from the undesignated fund  
balance of the 2023 Grant Fund in acceptance of funding provided by the  
Organized Crime Enforcement Task Force for use by the Jackson County  
Drug Task Force for “Operation Bad Cookie.”

AN ORDINANCE transferring $242,374.00 within the 2023 Sheriff’s Office  
General Fund and appropriating $302,374.00 from the undesignated fund  
balance of the 2023 General Fund, in acceptance of the Sheriff’s Office’s  
DWI/Traffic Safety Unit Salary Grant awarded by the Missouri Department of  
Transportation, Traffic and Highway Safety Division, and authorizing the  
County Executive to execute a contract with the Missouri Highway Safety  
Division for the acceptance and expenditure of grant funds.

AN ORDINANCE appropriating $34,600.00 from the undesignated fund  
balance of the 2023 Grant Fund in acceptance of the Sheriff’s Office’s  
Impaired Driving Enforcement grant awarded by the Missouri Department of  
Transportation, Highway Safety and Traffic Division, and authorizing the  
County Executive to execute a contract with the Missouri Highway Safety  
Division for the expenditure of grant funds.

RESOLUTIONS IN COMMITTEE  
A RESOLUTION authorizing the County Counselor to execute an Addendum  
to the existing Legal Services Agreement with Husch Blackwell, LLP of  
Kansas City, MO, for county-wide anti-discrimination and anti-harassment  
training at an actual cost to the County in the amount of $20,000.00.

A RESOLUTION awarding a contract for the furnishing of annual software  
maintenance for use by the Sheriff’s Office to Omnigo Software of St. Louis,

The County Legislature went into closed meeting per Resolution #21427.  
The County Legislature reconvened.  
Due to upcoming conflicts with the Missouri Association of Counties  
conference and meetings related to the 2024 budget, motions were made to  
change the date and times of future legislative meetings.  
A motion was made by Manuel Abarca IV, seconded by Donna Peyton to  
reschedule the November 20th legislative meeting to TUESDAY, November  
21, 2023 at 3 p.m. The motion passed by a voice vote.  
A motion was made by Manuel Abarca IV, seconded by Donna Peyton to  
schedule a legislative meeting on Tuesday, November 28 at 10 A.M.,  
Wednesday, November 29 at 12:30 P.M. and Friday December 1 at 9 A.M.  
to coincide with budget hearings. The motion passed by a voice vote.  
A motion was made by Manuel Abarca IV, seconded by Donna Peyton to  
reschedule the December 4th legislative meeting to Wednesday, December  
6, 2023 at 3 P.M. The motion passed by a voice vote.  
The County Legislature will schedule a public hearing on the 2024 budget at  
this meeting.  
The Clerk of the County Legislature will email and post the revised  
legislative meeting schedule.
