A motion was made by Jeanie Lauer, seconded by Megan L. Marshall to  
approve the journal of the previous meeting held on August 07, 2023. The  
motion passed by a voice vote.

COMMUNICATIONS WITH AND REPORTS OF THE COUNTY EXECUTIVE  
The County Executive was not present.  
Troy Schulte, County Administrator, said there was no report.  
Manual Abarca IV, County Legislator, asked for an update on the Board of  
Equalization process. Mr. Schulte said the BOE is meeting Monday  
through Friday, 8 a.m. to 5 p.m., mostly handling approval of stipulations  
and waivers of appearance. The hearing officers are handling about 150  
cases a day. The process is working. They have resolved 31.5% of cases.  
The process is likely to slow down once they begin hearing cases that  
have not had a stipulation. The Assessment Department continues to work  
with Tyler Technologies and are offering stipulations for some applicants  
with agricultural properties in the far eastern portion of Jackson County.  
They will continue to try to resolve these cases as quickly as possible. He  
will pull some data for Mr. Abarca regarding the stipulations and  
percentage of value changes. Mr. Abarca asked for data on properties with  
over 15% difference.  
Mr. Abarca asked if there was any response to the State Auditor’s request.  
Mr. Schulte said they will put the information together and send it off to the  
auditor. DaRon McGee, County Legislator, asked for the Legislature to be  
copied on that response.  
Mr. Abarca asked the County Executive’s opinion on American Rescue  
Plan Act Fund processes. Mr. Schulte said he believes there have been  
conversations between the Administration and Legislative staff on  
priorities for the ARPA funds. Mr. Abarca said it seems the County  
Executive is prioritizing buildings. Additionally, the County Executive  
spoke at a meeting and offered $5 million from ARPA for small  
businesses. Mr. Schulte said he would seek more information from the  
Administration.  
Mr. Abarca asked about the County Executive’s position on SB190. Mr.  
Schulte said the County Administration perspective is that there is  
uncertainty regarding the intent of this legislation. They hope to develop a  
framework that will allow them to work toward implementing the legislation,  
freezing those eligible seniors (62 and older) at the 2023 levels and start  
an application process that would run until September 2024.  
Bryan Covinsky, County Counselor, said his office is part of a working  
group with the Missouri Association of Counties. There is no county in  
Missouri that has enacted the law for this year because of the uncertainty  
with the law. They hope to find a way to get it properly done with a  
consistent process. There are many holes with the law that need to be  
clarified. Mr. Abarca said he believes Jackson County is unique in the  
number of appeals. Mr. Covinsky said St. Louis County consistently has  
more than 30,000 BOE appeals. Mr. Abarca asked if there are any other  
counties in Missouri with over 50,000 appeals. He asked Mr. Covinsky to  
have an answer to that question by the next legislative meeting.  
Sean E. Smith, County Legislator, said he had sent a list of questions  
regarding the appeal process. He said some taxpayers have received a  
stipulation in the mail that disagreed with the one they received in the  
appeal process. His understanding is the lowest stipulation number is what  
will be applied. He asked about the County Counselor’s Office signing off  
on stipulations. Mr. Covinsky said his office is part of the process and  
there is an attorney at all BOE hearings to sign the stipulations. The  
County Counselor’s Office represents the Assessment Department. Mr.  
Smith asked when taxpayers will see the county’s website reflect the  
stipulated value. Mr. Schulte said it normally takes 7 to 10 days to update  
the online system. The numbers are uploaded weekly.  
Mr. Smith asked about the process for anyone, with a good reason, asking  
for a late appeal. Mr. Schulte said the taxpayer should send a letter to the  
BOE email address: boardofequalization@jacksongov.org stating their  
reason for needing a late appeal. The Board of Equalization will have to  
decide to accept each individual late appeal, depending on the reason for  
lateness, such as hospitalization or deployed military personnel. Informal  
appeals are set to end tomorrow, but the BOE hearing officers will continue  
to handle appeals until all appeals have been heard. The BOE is not  
currently having in-person hearings. Right now, that process is through  
Zoom or phone only. Mr. Abarca said he still hopes to have a hearing on  
the equity of having Zoom-only hearings.  
Manuel Abarca IV asked about the holdup within the Administration and  
Human Resources Department on the approval of staff positions for the  
Legislative Auditor and Compliance staff. Troy Schulte said the positions  
have been approved and paperwork is on the County Executive’s desk for  
approval. The County Executive has requested a meeting with the Chair of  
the Legislature to discuss the situation further.  
Mr. Abarca asked about a term sheet with the Royals. Mr. Covinsky said  
his office wrote and distributed a request for qualifications for outside  
counsel on this issue. There is privileged and confidential information on  
the term sheet. Mr. Abarca suggested scheduling a closed meeting so the  
County Legislature can be informed. Mr. Covinsky said he will schedule a  
closed meeting as soon as the RFQ closes on August 15, 2023.

PERFECTION OF PROPOSED ORDINANCES AND REPORTS OF COMMITTEE  
AN ORDINANCE appropriating $23,000,000.00 from the undesignated fund  
balance of the 2022 ARPA Fund for the purpose of construction  
improvements and furnishings of the 1300 Washington Administration  
Building at a cost of $17,000,000.00, and for improvements to the second  
floor of the Downtown Courthouse at a cost of $4,000,000.00 and the  
Historic Truman Courthouse at a cost of $2,000,000.00.

Mr. Abarca said the committee is awaiting testimony from the County  
Executive.  
AN ORDINANCE appropriating $200,000.00 from the undesignated fund  
balance of the 2023 American Rescue Plan Fund and awarding a  
twelve-month contract, with two twelve-month options to extend, for the  
furnishing of community surveys and engagement software to Zencity of  
Harris County, Texas under the terms and conditions of OMNIA Partners  
contract no. 191902, an existing government contract.

AN ORDINANCE enacting section 2057., Jackson County Code, 1984,  
relating to a property tax credit to eligible taxpayers within Jackson County,  
Missouri, in accordance with the Revised Statutes of Missouri §137.1050  
(SB190), with an effective date.
