A motion was made by Jeanie Lauer, seconded by Megan L. Marshall to  
approve the journal of the previous meeting held on July 31, 2023. The  
motion passed by a voice vote.

HEARINGS

COMMUNICATIONS WITH AND REPORTS OF THE COUNTY EXECUTIVE  
Manual Abarca IV, County Legislator, said the County had recently  
received resolutions from municipalities located within Jackson County  
regarding the assessment process. He asked the Administration if they  
had any thoughts regarding these resolutions. Troy Schulte, County  
Administrator, said the County received resolutions from Independence,  
Blue Springs, Lee’s Summit, and Grain Valley. Mr. Abarca asked how  
many appeals were received. Mr. Schulte said the final number of appeals  
was 54,438.

PERFECTION OF PROPOSED ORDINANCES AND REPORTS OF COMMITTEE  
AN ORDINANCE appropriating $23,000,000.00 from the undesignated fund  
balance of the 2022 ARPA Fund for the purpose of construction  
improvements and furnishings of the 1300 Washington Administration  
Building at a cost of $17,000,000.00, and for improvements to the second  
floor of the Downtown Courthouse at a cost of $4,000,000.00 and the  
Historic Truman Courthouse at a cost of $2,000,000.00.

A motion was made by Megan L. Marshall, seconded by Manuel Abarca IV  
to perfect Ordinance #5769. The motion passed by a voice vote.

A motion was made by Megan L. Marshall, seconded by Venessa Huskey,  
to adopt Ordinance #5769, appropriating $3,000,000.00 from the  
undesignated fund balance of the 2023 Health Fund in acceptance of funds  
from the opioid class action legal settlement and authorizing the County  
Executive to enter into an agreement with University Health for the purpose  
of constructing a new opioid treatment center. The motion passed by a roll

contract no. 191902, an existing government contract.

AN ORDINANCE appropriating $18,000.00 from the undesignated fund  
balance of the 2023 Grant Fund in acceptance of grant funds awarded to the  
Family Court Division by the Family Court Committee of the Supreme Court  
of Missouri for the Juvenile Justice Program Assistance Grant.

AN ORDINANCE repealing sections 5400. and 5410., Jackson County  
Code, 1984, relating to the building code, and enacting, in lieu thereof, two  
new sections relating to the same subject.

AN ORDINANCE appropriating $25,000.00 from the undesignated fund  
balance of the 2023 Grant Fund, in acceptance of a grant received from the  
United States Office of National Drug Control Policy, High Intensity Drug  
Trafficking Area program, for use by the Jackson County Drug Task Force.

A RESOLUTION awarding a thirty-six month contract, with two twelve-month  
options to extend, for the furnishing of comprehensive medical, dental, and  
pharmaceutical services to inmates at the Jackson County Detention Center  
to Advanced Correctional Healthcare of Peoria, IL, under the terms and  
conditions of Request for Proposals No. 23-014 at an actual cost to the  
County for 2023 not to exceed $3,408,500.00.

INTRODUCTION OF PROPOSED ORDINANCES AND ASSIGNMENT TO COMMITTEE  
Enacting section 2057., Jackson County Code, 1984, relating to a property  
tax credit to eligible taxpayers within Jackson County, Missouri, in  
accordance with the Revised Statutes of Missouri §137.1050 (SB190), with  
an effective date.

INTRODUCTION OF PROPOSED RESOLUTIONS AND ASSIGNMENT TO COMMITTEE  
Transferring $500,000.00 within the 2023 Anti-Crime Sales Tax Fund for the  
furnishing of outpatient substance abuse treatment for use by the 16th  
Circuit Court of Jackson County.  
(Assigned to the Anti-Crime Committee.)  
Awarding twenty-four month term and supply contracts, with one  
twelve-month option to extend, for the furnishing of auto, truck, and  
motorcycle maintenance and repair services for use by various County  
departments to Naura, Inc., dba AAMCO Blue Springs of Blue Springs, MO,  
Bird Automotive of Blue Springs, MO, Glenn’s Tire and Automotive, Inc. of  
Independence, MO, KC Wholesale of Oak Grove, MO, Metro Ford, Inc., of  
Independence, MO, Midway Ford Truck Center Inc. of Kansas City, MO, and  
Worth East, LLC, dba Outlaw Harley-Davidson of Blue Springs, MO, under  
the terms and conditions of Invitation to Bid No. 23-034.

Discussion regarding Resolution #21358.  
Jeanie Lauer, County Legislator, asked for specific dollar amounts  
involved with this resolution. Troy Schulte said he would need to check  
records for specific amounts. Right now, there is a pending invoice in the  
amount of $800,000.00 and a balance of about $4.2 million that has not  
been billed. Ms. Lauer asked under what provision these funds would be  
released. Mr. Schulte said the Administration is not intending to release  
payment until there is satisfaction of certain goals under consideration  
between the County and Tyler Technologies. These are predominantly  
related to customer service issues. Ms. Lauer asked if the Administration  
was interested in making payment without the adoption of this resolution.  
Mr. Schulte said no, withholding payment is the County’s mechanism for  
holding Tyler accountable as they work through these contractual issues.  
Sean E. Smith, County Legislator, asked about the number of days in the  
contract with Tyler on assistance with informal appeals and Board of  
Equalization hearings. He asked if the County had exceeded the allotted  
days. Mr. Schulte said no, the informal appeals end on August 15, 2023. If  
the County were to exceed the number of days Tyler had agreed upon, the  
County would deploy in-house resources. Both informal appeals and BOE  
appeals are running about 50 appeals per morning.  
Donna Peyton, County Legislator, said she understands the resolution is  
to withhold payment. Is this pending any specific satisfaction to resume  
payment or is this to discontinue all payments? Manuel Abarca IV said he  
believes the goal is to have any future payments approved by the  
Legislature.  
A motion was made by Manuel Abarca IV, seconded by Sean E. Smith, to  
adopt Resolution #21358, urging the Jackson County Executive to withhold  
any future financial disbursement to Tyler Technologies of Moraine, OH  
relating to maintenance of assessment data, a computerized mass  
appraisal system, and reassessment services. The motion passed by a roll

that the Board of Equalization review the assessment process for legal  
defects and deficiencies and equalize property valuations subsequent to  
such an inquiry.

adopt Resolution #21361, congratulating the Taylor family on the occasion

adopt Resolution #21363, authorizing the Jackson County Legislature to  
hold a closed meeting on Monday, August 7, 2023, for the purpose of  
conducting privileged and confidential communications between itself and  
the Jackson County Counselor under section 610.021(1) of the Revised  
Statutes of Missouri, and closing all records prepared for discussion at said  
meeting. The motion passed by a roll call vote:

I hereby make the following appointment and reappoint to the Mid-Continent  
Library Board of Trustees.  
Marcie Gragg is appointed to fill the vacancy occasioned by the retirement  
of Brent Schondelmeyer, for a term that expires on June 30, 2026. A copy of  
Ms. Gragg’s resume is attached.  
Joycelyn Tucker-Burgo is reappointed for a term to expire June 30, 2027. A  
copy of Ms. Tucker-Burgo’s resume is attached.
