AN ORDINANCE amending the zoning districts established pursuant to the Unified Development Code by rezoning a certain 3.01± acre tract from District AG (Agricultural) to District RE (Residential Estates).

Body

 BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:

 

Section 1. The Zoning Order of Jackson County, Missouri, and the official maps which are a part thereof are amended by changing the boundaries of the "AG" (Agricultural) and “RE” (Residential Estates) Districts, so that there will be transferred from District AG to District RE a tract of land, located at 17208 E. Courtney Atherton Road, in Jackson County, MO, legally described as follows:

 

That part of the Northeast Quarter of Section 18, Township 50, Range 31, in Jackson County, Missouri, described as follows: Commencing at the Southwest Corner of said Northeast Quarter; thence South 87 degrees 28 minutes 30 seconds East along the South line thereof, a distance of 16.50 feet to the point of beginning; thence North 02 degrees 40 minutes 44 seconds East, a distance of 399.21 feet; thence South 87 degrees 20 minutes 26 seconds East, a distance of 128.50 feet; thence South 02 degrees 40 minutes 44 seconds West 64.50 feet; thence South 87 degrees 28 minutes 30 seconds East, a distance of 248.70 feet; thence South 02 degrees 40 minutes 44 seconds West, a distance of 334.41 feet to a point of the South line of said Northeast Quarter; thence North 87 degrees 28 minutes 30 seconds, along said line, a distance of 377.20 feet to the point of beginning. Except that part in roads.

 

 

 

 

 

Section 2. The Legislature, pursuant to the application of Michael and Kim Hawley (RZ-2023-644), requesting the amendment embodied in this Ordinance and with notice that the Jackson County Plan Commission voted 5 to 0 to recommend APPROVAL of this application after a public hearing on March 16, 2023, does hereby adopt this Ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.

Effective Date: This Ordinance shall be effective immediately upon its signature by the County Executive.
