A RESOLUTION authorizing the County Executive to execute a Memorandum of Agreement with the Missouri State Historic Preservation Office, relating to federal funding for the Greenwood Connector Phase 1 Trail project.

RESOLUTION NO. 21236, April 17, 2023

Body

 WHEREAS, the Federal Highway Administration, Missouri Division, a federal agency, is responsible for ensuring the Greenwood Connector Phase I Trail project complies with Section 106 of the National Historic Preservation Act; and,

 

WHEREAS, the Missouri Department of Transportation (MoDOT) administers federal aid projects throughout Missouri and MoDOT Historic Preservation staff assisted the parties in drafting an agreement document and aided in its execution; and,

 

WHEREAS, the duties of the Missouri State Historic Preservation Officer are to advise, assist, review, consult with federal agencies as they carry out historic preservation; and, 

 

WHEREAS, the County plans to construct a 16.5 mile, 10 foot wide, bicycle and pedestrian shared use path in the County using funding from the Surface Transportation Program and Transportation Alternatives Program funded by the Federal Highway Administration; and, 

 

 

 

WHEREAS, a prior Memorandum of Agreement (MOA) was executed by the parties to this agreement related to federal projects on August 22, 2017, which determined that the projects had an adverse effect on historical railroad property and created stipulations and mitigations which have all been fulfilled; and,

 

WHEREAS, the prior MOA included incorrect information regarding the length of the project, and expired prior to the correction of such information; and,

 

WHEREAS, the Federal Highway Administration has determined that the improvements to Rock Island and Pacific Corridors under the current project number will result in no additional adverse effects; and, 

 

WHEREAS, the execution of the attached MOA is in the best interests of the health, welfare, and safety of the citizens of Jackson County; now therefore,

 

BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the attached Agreement is approved and that the County Executive is authorized to execute on behalf of the County the attached MOA and any other documents necessary to give effect to this Resolution.

 

 

 

 

 

Enacted and Approved

Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
