RESOLUTION NO. 20693, June 14, 2021

Body

 WHEREAS, the Kansas City Main Street Rail Transportation Development District (TDD) is organized under sections 238.000 to 238.275, RSMo (the “TDD Act”) and is involved in extending and operating Kansas City’s streetcar/light rail system; and,

 

WHEREAS, by a mail-in election held June 18, 2018, the TDD was authorized to levy certain special assessments against real property in the TDD; and,

 

WHEREAS, the TDD Act provides that the County Collector is to collect these special assessments in accordance with the provisions of the TDD Act; and,

 

WHEREAS, pursuant to Resolution 18255, dated September 9, 2013, the County did enter into a Cooperative Agreement for Collection of Kansas City Downtown Streetcar Special Assessments with the Kansas City Downtown Streetcar Transportation Development District to govern how special assessments would be collected for a similar and predecessor district which is also involved in establishing and operating the streetcar system; and,

 

WHEREAS, the attached Cooperative Agreement, which is similar to the County’s existing agreement, is a suitable mechanism by which to implement the understanding of the parties in this regard; and,

 

WHEREAS, the execution of this Agreement is in the best interest of the health, safety, and welfare of the citizens of Jackson County; now therefore,

 

BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the attached Cooperative Agreement for Collection of the Kansas City Main Street Rail TDD Special Assessments with the Kansas City Main Street Rail TDD be and hereby is approved; and,

 

BE IT FURTHER RESOLVED that the County Executive be and hereby is authorized to execute the attached Agreement.

 

Enacted and Approved

Effective Date:  This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
