AN ORDINANCE appropriating $2,452.00 from the undesignated fund balance of the 2021 Park Fund and authorizing the County Executive to execute an easement in favor of the City of Lee’s Summit, MO, to allow for the installation of a permanent sanitary sewer line across a portion of the Rock Island Rail Corridor.

Body
WHEREAS, the City of Lee’s Summit has requested an easement across a portion of the Rock Island Rail Corridor property located in the Northwest quarter of Section 12, Township 47 North, Range 32 West, in Lee’s Summit, to allow for the installation of a permanent sanitary sewer line; and,
WHEREAS, the Director of Parks + Rec recommends the County Executive be authorized to execute the attached permanent easement in favor of the City of Lee’s Summit for the installation of the requested permanent sanitary sewer line; and,
WHEREAS, the City has agreed to pay the County easement and processing fees required by the County Code, totaling $2,452.00, and,
WHEREAS, the execution of the attached easement is in the best interests of the health, welfare, and safety of the citizens of Jackson County; now therefore,
BE IT ORDAINED by the County Legislature of Jackson County, Missouri, that the following appropriation be and hereby is made:

BE IT FURTHER ORDAINED that the attached Permanent Easement is hereby approved and that the County Executive is hereby authorized to execute on behalf of the County the Easement and any other documents necessary to give effect to this Ordinance.

Effective Date: This ordinance shall be effective immediately upon its signature by the County Executive.
