Body
WHEREAS, a revision to section 9202. of the County Code is necessary to allow for the transfer of certain proceeds of the County park levy from the Convention and Sports Complex Fund into the Park Fund; and

WHEREAS, these park levy proceeds have been determined to be not legally required to be deposited into the Convention and Sports Complex Fund to meet the County's contractual and legal obligations with regard to the Harry S Truman Sports Complex; and

WHEREAS, the recommended code revision will allow the park levy proceeds to be used for other park purposes; now therefore

BE IT ORDAINED by the County Legislature of Jackson County, Missouri, as follows:

Section 1. Enacting Clause.
Section 9202. Jackson County Code, 1984, is hereby repealed and one new section enacted in lieu thereof, to be known as section 9202., to read as follows:


9202. Convention and Sports Complex Fund.
There is hereby established the Jackson County Convention and Sports Complex Fund ("the Fund"), which shall be maintained separately from the general funds of the County and which shall be subject to the provisions of the Charter of Jackson County.


9202.1 Use of Monies.
Monies in the Fund shall be used solely for the purpose of developing, maintaining, or operating qualifying projects at the Harry S. Truman Sports Complex (the "Sports Complex"). Monies in the Fund that have been determined to be not legally required to meet the County's statutory or contractual obligations regarding the Sports Complex may be deposited into the separate County fund into which the proceeds of the Fund's source tax levy would otherwise be required to be deposited.
