AN ORDINANCE directing the County Executive to execute on behalf of the County the Cooperative Agreement with Westside Community Action Network, Inc.

Body

 WHEREAS, pursuant to Article II, Section 16.13 of the Jackson County Charter, the County Legislature has the power to:

Contract and be contracted with and to authorize the making of contracts on behalf of the county by county officers, and establish by county ordinance authority, limitations and procedures for making and review of such contracts;

and,

 

WHEREAS, pursuant to Article III, Section 6.5 of the Jackson County Charter, the County Executive shall:

Execute and enforce the provisions of this charter, and the ordinances, resolutions and policies of the County Legislature, and the laws of the state pertaining to the government of the county; see that all contracts with the county are faithfully performed and cause to be instituted in the name of the county appropriate actions thereon;

and,

 

WHEREAS, pursuant to Article III, Section 6.10 of the Jackson County Charter, the County Executive shall:

Represent the county and perform such other duties as may be prescribed by this charter or be required of the County Executive by ordinance or resolution of the County Legislature or as may be implied by the powers and duties specified in this charter, law or county ordinance;

and,

WHEREAS, pursuant to Resolution No. 20461, dated July 13, 2020, the County Legislature did transfer $32,445.00 within the 2020 General Fund and authorize the County Executive “to execute a Cooperative Agreement with Westside CAN, on the terms outlined in [the] Resolution, in a form to be approved by the County Counselor;” and,

 

WHEREAS, the County Counselor has prepared and approved the form of the Cooperative Agreement, and Westside CAN has executed the Cooperative Agreement; and,

 

WHEREAS, County Executive has yet to execute the Cooperative Agreement with Westside Community Action Network; now therefore,

 

BE IT ORDAINED by the County Legislature of Jackson County, Missouri, that the County Executive is directed to execute on behalf of Jackson County the Cooperative Agreement with Westside Community Action Network, Inc., Contract No. PC50232020002, and to file three fully executed originals of the Cooperative Agreement with the Clerk of the Legislature by 4:00 p.m. of the second business day following the day that this Ordinance becomes effective; and,

 

BE IT FURTHER ORDAINED by the County Legislature of Jackson County, Missouri, that the Director of Finance and Purchasing be and hereby is authorized and directed to make all payments, including final payment on the Agreement.

 

Enacted and Approved

Effective Date: This ordinance shall be effective immediately upon its signature by the County Executive.
