AN ORDINANCE declaring certain personal property in the custody of the Parks + Rec Department as surplus and unusable property and authorizing its disposal.

 

 

Intro

ORDINANCE NO. 5213, April 1, 2019

 

INTRODUCED BY Dan Tarwater III, County Legislator

 

 

Body

 WHEREAS, the Parks + Rec Department has requested thirty thousand ± stadium seats removed from Arrowhead Stadium during a seat replacement project be declared surplus and disposed of; and,

 

WHEREAS, the Director of Finance and Purchasing recommends that said property be declared surplus and unusable; and,

 

WHEREAS, the Legislature has determined that it is in the best interest of the health, safety, and welfare of the citizens of Jackson County that the Kansas City Chiefs Football Club, Inc., which is managing the seat replacement project, be authorized to sell or otherwise dispose of the seats on terms it finds to be mutually advantageous, with the net proceeds of the disposition to be turned over the County; now therefore,

 

BE IT ORDAINED by the County Legislature of Jackson County, Missouri, that the above-described thirty ± thousand seats located at Arrowhead Stadium be and hereby are declared surplus, and that the Director of Finance and Purchasing be and hereby is authorized to contract with the Kansas City Chiefs Football Club, Inc., for the disposal  of the seats by the Chiefs on terms deemed by the Chiefs to be mutually advantages on to the Chiefs and the County, as a one-time exception to the County property disposal procedures set out in chapter 11 of the county code, with the net proceeds of such disposal to be turned over to the County; and,

 

BE IT FURTHER ORDAINED that the Director of Finance be and hereby is authorized to execute any and all documents necessary to give effect to the intent of this Ordinance.

Effective Date:  This ORDINANCE shall be effective immediately upon its passage by a majority of the Legislature.
