Title

AN ORDINANCE renewing a conditional use permit (CUP) in District AG (Agricultural) for a period of twenty years to operate a horse boarding stable, subject to specified conditions as to a 15.00 ± acre tract.

ORDINANCE NO. 5184, November 27, 2018

 

 

Body

 BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:

 

Section 1.  A conditional use permit is hereby renewed for a period of twenty years to operate a horse boarding stable, as to an approximate 17.5 + acre tract of land commonly known as 11420 S. Milton Thompson Road, Jackson County, MO, and specifically described as follows:

 

Description: 

 

All that part of the West Half of the Southwest Quarter of Section 1, Township 47, Range 31, in Jackson County, Missouri, described as follows: Commencing at the Southwest of said Half of Quarter Section; thence North 0 degrees 13 minutes West along the West line of said Half of Quarter section, 490.91 feet; thence South 90 degrees East, 1,331.00 feet to the East line of said Half of Quarter Section; thence South 0 degrees 13 minutes East,490.91 feet to the Southeast corner of said Half of Quarter Section; thence North 90 degrees, West and along the South line of said Half of Quarter, 1,331.00 to the point of beginning.  

 

 

 

 

Section 2.  The conditional use permit for a period of twenty years renewed by this Ordinance is subject to the following condition:                     

 

1)                     The number of horses shall be limited to no more than 38 (thirty eight) at any one time.

 

 

 

 

 

Section 3.  The Legislature, pursuant to the application of Nina L. Pointer (CU-2018-230), requesting approval embodied in this Ordinance and with notice that the Jackson County Plan Commission voted 7 to 0 to recommend APPROVAL of this application in a public hearing on November 15, 2018, does adopt this Ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.

 

Enacted and Approved

Effective Date:  This Ordinance shall be effective immediately upon its signature by the County Executive.
