AN ORDINANCE renewing a conditional use permit (CUP) in District RR (Residential Ranchette) for a period of twenty years to operate a horse boarding and training facility, subject to specified conditions as to a 15.00 ± acre tract.

Body

 BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:

 

Section 1.  A conditional use permit is hereby renewed for a period of twenty years to operate a horse boarding stable, as to an approximate 15.00 + acre tract of land commonly known as 31606 E. Hammond Road, Jackson County, MO, and specifically described as follows:

 

Description: 

 

15 acres square in the Southwest Quarter of the Southeast Quarter of Section 34, Township 48, Range 30, Jackson County, Missouri of the following described tract:

 

Part of the east half of Section 34, Township 48, Range 30, Jackson County, Missouri, described as follows: Commencing at the Southwest corner of the Southeast Quarter of said Section 34; thence North 01 degrees 58 minutes 18 seconds East along the West line of said Southeast Quarter, 45.28 feet; thence South 88 degrees 01 minutes 42 seconds East, 40.00 feet to the Point of Beginning; thence North 01 degrees 58 minutes 18 seconds East along the East right of way of Buckner Tarsney Road (40.00 East and parallel to the West line of said Southeast Quarter), 1942.53 feet; thence; South 88 degrees 32 minutes 51 seconds East, 1279.08 feet; thence North 01 degrees 58 minutes 44 seconds East, 663.38 feet; thence North 02 degrees 08 minutes 14 seconds East, 663.00 feet; thence South 88 degrees 37 minutes 16 seconds East, 1321.18 to a point on the East line of said Section 34; thence South 02 degrees 18 minutes 34 seconds West along the East line of said Section 34, 663.82 feet; thence South 01 degrees 59 minutes 10 seconds West along the east line of said Section 34, 333.64 feet; thence North 88 degrees 30 minutes 07 seconds West, 659.56 feet (deed 654.36 feet); thence South 01 degrees 58 minutes 57 seconds West, 2302.62 feet to a point on the North right of way of Hammond Road (20.00 North of the South line of the Southeast Quarter of said Section 34); thence North 88 degrees 25 minutes 54 seconds West along said North right of way, 1913.21 feet; thence North 43 degrees 13 minutes 52 seconds West, 35.23 feet to the point of Beginning.

 

Except for the following tracts of land:

 

Lot 1, Lee-Hammond Acres, a subdivision in Jackson County, Missouri.

 

Lot 2A, Lee-Hammond Acres 3rd Plat, a subdivision in Jackson County, Missouri.

 

Lot 3, Lee-Hammond Acres 3rd Plat, a subdivision in Jackson County, Missouri.

 

 

 

Section 2.  The conditional use permit for a period of twenty years renewed by this Ordinance is subject to the following conditions:                     

 

1)                     No overnight parking of camper or lodging shall be provided on the premises.

 

2)                     No horse shows, commercial concession stands, or retail tack rooms shall be provided on the premises.

 

3)                     All outdoor arena lighting shall be turned off no later than 11:00 p.m. each night.

 

4)                     The number of horses shall be limited to no more than 20 (twenty) at any one time.

 

 

 

 

 

Section 3.  The Legislature, pursuant to the application of Clifford Lee (CU-2018-228), requesting approval embodied in this Ordinance and with notice that the Jackson County Plan Commission voted 7 to 0 to recommend APPROVAL of this application in a public hearing on November 15, 2018, does adopt this Ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.

 

 

 

 

 

 

 

Enacted and Approved

Effective Date:  This Ordinance shall be effective immediately upon its signature by the County Executive.
