Body
WHEREAS, by Resolution 19682, dated December 28, 2017, the Legislature did authorize a contract with aSTEAM Village to provide a recreation program for the citizens of Jackson County, to be funded out of the proceeds of the County's Park Fund; and,


WHEREAS, subsequent to the adoption of this Resolution, it was determined, after a legal review, that section 64.320, RSMo, does not allow for the expenditure of Park Fund proceeds for recreation programs that are conducted at locations other than County park property; and,

WHEREAS, this determination thus now requires that the County identify an alternative funding source for the contract with aSTEAM Village authorized by Resolution 19682; and,

WHEREAS, as the Legislature has previously found, the funding of this program is in the best interests of the health, welfare, and safety of the citizens of Jackson County; and,

WHEREAS, by Ordinance 5062, dated December 6, 2017, the Legislature did establish certain Reserve Accounts for certain budget lines within the 2018 County budget; and,

WHEREAS, certain funds appropriated in such Reserve Accounts within the 2018 General Fund are needed to cover the cost of the identified outside agency contract; and,

WHEREAS, there are numerous disputes between the County Executive and the Legislature regarding the validity of Ordinance 5062, relating to its construction and interpretation, and multiple related issues; and,

WHEREAS, the Chief Administrative Officer has recommended the adoption of this Resolution, without waiving any previous position taken...
