IN THE COUNTY LEGISLATURE OF JACKSON COUNTY, MISSOURI
Title
AN ORDINANCE appropriating $92,762.00 from the undesignated fund balance of and transferring $391,870.00 within the 2018 Health Fund, transferring $7,600.00 within the 2018 General Fund and $492,232.00 within the 2018 Park Fund, and authorizing certain additional actions with regard to seven contracts with outside agencies previously authorized by the Legislature.

Body
WHEREAS, by Resolution 19682, dated December 28, 2017, and Resolution 19855, dated May 7, 2018, the Legislature did authorize contracts with certain identified outside agencies to provide various public health and recreation programs for the citizens of Jackson County, to be funded out of the proceeds of the County’s Health and Park Funds; and,
WHEREAS, subsequent to the adoption of these Resolutions, it was determined, after a legal review, that section 64.320, RSMo, does not allow for the expenditure of Park Fund proceeds for recreation programs that are conducted at locations other than County park property; and,
WHEREAS, this determination thus now requires that the County identify alternative funding sources for the contracts authorized by Resolutions 19682 and 19855 with the St. Patrick’s Day Parade Committee, the Kansas City Sports Commission, Morningstar Community Development, Science City, United Inner City Services, the University of Missouri Extension Center, and Guadalupe Center (Youth Recreation Program); and,
WHEREAS, as the Legislature has previously found, the funding of these programs is in the best interests of the health, welfare, and safety of the citizens of Jackson County; and,
WHEREAS, by Ordinance 5062, dated December 6, 2017, the Legislature did establish certain Reserve Accounts for certain budget lines within the 2018 County budget; and,
WHEREAS, certain funds appropriated in such Reserve Accounts within the 2018 General and Health Funds are needed to cover the costs of the identified outside agencies contracts; and,
WHEREAS, there are numerous disputes between the County Executive and the Legislature regarding the validity of Ordinance 5062, relating to its construction and interpretation, and multiple related issues; and,
WHEREAS, the Chief Administrative Officer has recommended the adoption of this Ordinance, without waiving any previous position taken in reliance upon the memorandum of the County Counselor dated December 22, 2017, regarding Ordinance 5062, and without waiving any position taken in reliance upon other legal memorandums provided by the Office of the County Counselor; and,
WHEREAS, the Legislature recognizes that funds identified as Reserve Funds in the adopted 2018 Budget within the General and Health Funds are required to be designated for outside agency contracts; and,
WHEREAS, the Chief Administrative Officer has requested that the funds identified in this Ordinance be made available for such use within the 2018 budget; and,
WHEREAS the County Legislature agrees that funds described in this Ordinance should be made available for such use by posting to certain budget line items for calendar year 2018 by the County’s Finance and Purchasing Department; now therefore,
BE IT ORDAINED by the County Legislature of Jackson County, Missouri, that the following appropriation and transfer or equivalent documentation/identification, to accomplish posting of the funds in the Jackson County Budget management system so that the funds are available for immediate use and expenditure within the 2018 Budget, be and hereby are authorized:

BE IT FURTHER ORDAINED that the County Executive, Chief Administrative Officer, and/or all other County officials be and hereby are authorized to execute appropriate contracts and/or contract amendments with the outside agencies identified in this Ordinance, and any and all other documents necessary to give effect to the intent of this Ordinance; and,
BE IT FURTHER ORDAINED that the Chief Administrative Officer, the Director of the Department of Finance and Purchasing, and/or all other County officials be and hereby are authorized to make any and all administrative adjustments to the County’s finance records and accounts relating to the 2018 contracts with the outside agencies identified in this Ordinance, as are necessary to give effect to the intent of this Ordinance.
Enacted and Approved
Effective Date: This ordinance shall be effective immediately upon its signature by the County Executive.
