AN ORDINANCE submitting to the qualified voters of Jackson County, at the general election to be held on Tuesday, November 6, 2018, a question authorizing Jackson County to levy a countywide tax at the rate of five cents per each one hundred dollars of assessed valuation, for the purpose of providing services to persons sixty years of age or older.

Body

 WHEREAS, sections 67.990 et seq., RSMo 2016, authorize the County to levy and collect a countywide ad valorem property tax, not to exceed five cents per each one hundred dollars of assessed valuation, for the purpose of providing services to persons sixty years of age or older; and,

 

WHEREAS, if authorized by the qualified voters of the County at the general election to be held Tuesday November 6, 2018, the proceeds of the tax would be deposited in a special “Senior Citizens’ Services Fund,” established within the County treasury, and administrated and managed by a seven-member board of directors appointed by the County Executive, in accordance within a budget approved by the County Legislature; and,

 

WHEREAS, monies in the Senior Citizens’ Services Fund would be available to provide programs which will improve the health, nutrition, and quality of  life of persons who are sixty years of age or older, and could be allocated for operational and capital needs to senior-related programs in the County; and,

 

WHEREAS, the submission of a question to the voters to authorize this tax is in the best interests of the health, welfare, and safety of the citizens of Jackson County; now therefore,

 

BE IT ORDAINED by the County Legislature of Jackson County, Missouri, as follows:

 

Section 1.                     Subject to the approval of the voters of Jackson County, at the general election to be held on November 6, 2018, the levy of an ad valorem property tax at the rate of five cents per each one hundred dollars of assessed valuation, is hereby authorized within and for Jackson County, Missouri.

 

Section 2.                     Pursuant to the provisions of section 67.990, RSMo 2016, there is hereby submitted to the qualified voters of Jackson County, Missouri, at the general election to be held on November 6, 2018, a question authorizing the levy of an ad valorem property tax at the rate of five (5) cents per each one hundred (100) dollars of assessed valuation for the purpose of providing services to persons sixty years of age or older.

 

Section 3.                     The qualified voters at said election shall vote by ballot and the ballots to be used at said election shall contain the following language:

QUESTION NO. 1

GENERAL ELECTION

NOVEMBER 6, 2018

OFFICIAL BALLOT

Shall Jackson County, Missouri, levy a tax of five (5) cents per each one hundred (100) dollars assessed valuation for the purpose of providing services to persons sixty years of age or older?

Section 4.  This Ordinance shall become effective upon approval of the question submitted by the voters of Jackson County at the general election on November 6, 2018.

 

Section 5                     This Ordinance shall be published as required by law.

 

Section 6                     The Clerk of the Legislature is hereby authorized and directed to notify the Jackson County Board of Election Commissioners and the Kansas City Board of Election Commissioners of the adoption of this Ordinance no later than August 28, 2018, by 5:00 p.m., and to include in said notification all the terms and provisions required by section 115.125, RSMo.

 

Enacted and Approved

Effective Date:  This Ordinance shall be effective immediately upon its signature by the County Executive.
