AN ORDINANCE renewing a conditional use permit (CUP) in District AG (Agricultural) for a period of ten years to operate a private kennel subject to specified conditions, as to a 10 ± acre tract.

ORDINANCE NO. 4968, April 3, 2017

 

 

Body

 BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:

 

Section 1.  A conditional use permit is hereby renewed for a period of ten years to operate a private kennel for dogs, as to an approximate 10 + acre tract of land commonly known as 4220 N. Koger Road, Sibley, MO, and specifically described as follows:

 

Description:  The North ½ of the South ½ of the Southeast ¼ of the Northeast ¼ of Section 1, Township 50, Range 31, Except part in Koger Road, in Jackson County, Missouri

 

 

Section 2.  The conditional use permit for a period of ten years renewed by this Ordinance is subject to the following conditions:                     

1.                     The number of Chihuahua dogs kept on the property is limited to fifteen (15).

2.                     The kennel shall be private and limited to only the property owner’s dogs and shall not be operated as a boarding/commercial animal establishment.

3.                     There shall be no on premise sign allowed for either identification or advertisement purposes

4.                     All dogs must be contained in the residence or the fenced area unless under the control of and obedient to the command of a responsible person.

 

 

Section 3.  The Legislature, pursuant to the application of Rosanna Don Carlos (CU-2017-221), requesting approval embodied in this Ordinance and with notice that the Jackson County Plan Commission voted 8 to 0 to recommend APPROVAL of this application in a public hearing on March 16, 2017, does adopt this Ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.

 

Enacted and Approved

Effective Date:  This Ordinance shall be effective immediately upon its signature by the County Executive.
