AN ORDINANCE transferring $1,100.00 within the 2016 Special Road and Bridge Fund, appropriating $410,253.00 from the undesignated fund balance of the 2016 Grant Fund, awarding a contract on Bid No. PW 07-2016 for the Browning Road Bridge Replacement Project, No. 3046, Federal Project BRO-NBIL-048(54) to Redford Construction of Raymore, MO, at a cost to the County not to exceed $410,253.00, and authorizing the Director of Public Works to approve line item adjustments under this contract at no additional cost to the County.

WHEREAS, by Ordinance 4628, dated June 9, 2014, the Legislature did authorize the execution of an Agreement with the Missouri Highways and Transportation Commission (“the Commission”) in connection with the Browning Road Bridge Replacement Project, No. 3046; and,
WHEREAS, this project is part of the Federal Highway Administration’s Off-System Bridge and Rehabilitation Program, in coordination with the Commission, which requires the County to fund the project up front, but provides for reimbursement of 80 percent of the costs; and,
WHEREAS, by Resolution 19114, dated March 28, 2016, the Legislature did authorize the execution of a Letter of Understanding with Lafayette County to trade federal funds for part of the 20 percent match credit for the County’s portion of costs related to this program; and,
WHEREAS, the Director of Public Works solicited proposals for this project on Bid No. PW 07-2016 and received eight submissions thereon, with the three lowest and best bids as follows:

WHEREAS, the Director of Public Works recommends the award of a contract for the Browning Road Bridge Replacement Project, No. 3046, Federal Project BRO-NBIL-048(54) to Redford Construction of Raymore, MO; and,
WHEREAS, the Commission issued a letter of concurrence related to the award of a contract to Redford Construction, with approval of costs not to exceed $409,153.00, with the remaining $1,100.00 of ineligible funds to be paid from the 2016 Special Road and Bridge Fund; and,
WHEREAS, in the event that line item adjustments to the contract become necessary, it is appropriate that the Director of Public Works be authorized to approve said line item adjustments to the extent there is no additional cost to the County; and,
WHEREAS, an appropriation and transfer are necessary to place the funds for this project in the proper spending accounts; and,
WHEREAS, the County Executive recommends said appropriation and transfer; now therefore,
BE IT ORDAINED by the County Legislature of Jackson County, Missouri, that the following transfer within the 2016 Special Road and Bridge Fund and appropriation from the undesignated fund balance of the 2016 Grant Fund be and hereby are made:

BE IT FURTHER ORDAINED by the County Legislature of Jackson County, Missouri, that award be made as recommended by the Director of Public Works, and that the County Executive be, and is hereby, authorized to execute for the County any documents necessary to the accomplishment of the award; and,
BE IT FURTHER ORDAINED that the Director of Public Works be and hereby is authorized to make adjustments in the contract line item quantities to the extent that there will be no further funding obligation to the County; and,
BE IT FURTHER ORDAINED that the Director of Finance and Purchasing is authorized to make all payments, including final payment on the contract.

Effective Date: This ordinance shall be effective immediately upon its signature by the County Executive.
