AN ORDINANCE amending the zoning districts established pursuant to the Unified Development Code by changing a certain 13.65 ± acre tract from District AG (Agricultural) to District RE (Residential Estates).

Body

 BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:

 

Section 1.  The Zoning Order of Jackson County, Missouri, and the official maps which are a part thereof, are amended by changing the boundaries of the "AG" (Agricultural) District and the "RE" (Residential Estates) District, so that there will be transferred from District AG to District RE, a tract of land commonly known as Blue Mills Road, Section 16, Township 50, Range 31 in Independence, MO, specifically described as follows:

 

Description:  A tract of land in part of the Southeast Quarter of Section 16, and part of the Southwest Quarter of Section 15, both in Township 50 North, Range 31 West, Jackson County, Missouri, and being more particularly described as follows: Commencing at the Southeast corner of said Section 16; thence along the South line of the Southeast Quarter of said Section 16, N 87°42’32” W, 1315.73 feet, to the Southwest corner of the Southeast Quarter of the Southeast Quarter of said Section 16; Thence along the West line of the Southeast Quarter of the Southeast Quarter of said Section 16, N 02°29’04” E, 664.07 feet; thence leaving said West line, N 34°43’45” W 907.47 feet, to a point on the South right-of-way line of East Blue Mills Road, as now established; thence along said South right-of-way line, N 77°29’25”E, 41.29 feet, thence along a curve to the left, having a curve length of 360.77 feet, and a curve radius of 2904.52 feet, with a chord bearing of N 73°55’55” E; thence N 70°22’25” E, 640.90 feet; thence along a curve to the right, having a curve length of 343.29 feet, and a curve radius of 914.84 feet, with a chord bearing of N 81°07’25” E; thence S 88°07’35” E, 46.90 feet, to the point of beginning;

 

Thence from the point of beginning continuing along said South right-of-way line, S 88°07’35” E, 343.40 feet; thence along a curve to the left, having a curve length, having a curve length of 328.93 feet, and a curve radius of 994.97 feet, with a chord bearing of N 82°24’10” E; thence leaving said South right-of-way line, S 02°33’00” W, 596.57 feet; thence; thence S 72°48’16” W, 254.16 feet; thence S 58°52’57” W 364.26 feet; thence S 44°11’16” W, 99.26 feet; thence S 45°48’44” W, 288.80 feet; thence North 30°01’28” W, 86.39 feet; thence N 35°04’56” W 96.43 feet; thence N 21°39’25” W, 157.22 feet, thence N 00° 29’25” W, 42.41 feet, thence N 17°16’53” E, 532.38 feet; thence; thence N 07°56’46” E, 198.15 feet; thence N 23°18’32” E, 57.64 feet, to the point of beginning.

Section 2.  The Legislature, pursuant to the application of the Crazy Horse Development (RZ-2016-540), requesting the amendment embodied in this Ordinance and with notice that the Jackson County Plan Commission voted 6 to 0 to recommend APPROVAL of this application after a public hearing on September 15, 2016, does adopt this Ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.

 

Enacted and Approved

Effective Date:  This Ordinance shall be effective immediately upon its signature by the County Executive.
