Body

 WHEREAS, the County Administration has been in discussions with Union Pacific Railroad Company to acquire a portion of Union Pacific right-of-way located in Jackson County known as the “Rock Island Rail Corridor,” from MP 288.3 to MP 270.6; and,

 

WHEREAS, Union Pacific and the County executed a Memorandum of Understanding on November 12, 2013, for Union Pacific to sell and for the County to purchase the specified portion of the Rock Island Rail Corridor; and,

 

WHEREAS, the Kansas City Area Transportation Authority has approved a Cooperative Agreement with Jackson County providing that the Kansas City Area Transportation Authority will pay for 50% of the purchase price for the Rock Island Rail Corridor; and,

 

 

WHEREAS, the establishment of the Office of the Rock Island Rail Corridor Authority will allow the County to manage and maintain the Rock Island Rail Corridor; and,

WHEREAS, the Office of the Rock Island Rail Corridor Authority has immediate expenditures anticipated to total approximately $1,400,000.00, related to the acquisition of the Rock Island Rail Corridor that include but are not limited to:

1.                     $250,000.00 escrow payment due upon execution of the Line Sale Agreement between Jackson County and Union Pacific Railroad Company.

 

2.                     Legal and consulting work related to the acquisition of the Rock Island Rail Corridor and management of the Office of the Rock Island Rail Corridor Authority.

 

3.                     Environmental, survey, title and other work related to the acquisition of the Rock Island Rail Corridor;

 

and,

 

 

 

WHEREAS, the Office of the Rock Island Rail Corridor Authority will work on a variety of topics related to the Rock Island Rail Corridor, including but not limited to, corridor engineering and design, legal and regulatory issues related to corridor real estate and property development, corridor maintenance, corridor safety, communications, branding regarding the corridor, federal funding procurement and administrative support; and,

 

WHEREAS, additionally, the Office of the Rock Island Rail Corridor Authority will work with consultants, contractors, stakeholders and the Kansas City Area Transportation Authority on the corridor; now therefore,

 

BE IT ORDAINED by the County Legislature of Jackson County, Missouri, that the Office of the Rock Island Rail Corridor Authority be and hereby is established and that the County Executive be and hereby is authorized to appoint the Director of such office; and,

 

BE IT FURTHER ORDAINED by the County Legislature of Jackson County, Missouri, that the following appropriation from the undesignated fund balance of the 2015 Special Road and Bridge Fund be and hereby is made:
