Body
WHEREAS, by Resolution 16911, dated May 18, 2009, the Legislature authorized the execution of a Memorandum of Understanding (MOU) between Jackson County, and the Cities of Kansas City, Missouri and Lee's Summit, Missouri, for improvements to Lee's Summit Road; and,

WHEREAS, due to the widening and straightening of the Lee's Summit Road for improved sight distance, it is necessary for the City of Kansas City to acquire additional right-of-way, permanent easements, and temporary easements from the County, beyond those specified in the original MOU; and,

WHEREAS, the Director of Public Works recommends the donation of the required right-of-way and easements in exchange for the City of Kansas City reclaiming an abandoned roadbed, and conveying it to Jackson County for use as green space; and,

WHEREAS, the County will benefit by have safer access to County-owned facilities in that area; and,

WHEREAS, the execution of appropriate Conveyance of Right-of-Way, Permanent Drainage, and Temporary Construction Easements is in the best interests of the health, welfare, and safety of the citizens of Jackson County; now therefore,

BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the attached agreements are hereby approved and that the County Executive is hereby authorized to execute on behalf of the County the indicated conveyance instruments and any other documents necessary to give effect to this Resolution, in forms to be approved by the County Counselor.
