Body
WHEREAS, by Resolution No. 16911, dated May 18, 2009, the Legislature did authorize the Director of Public Works to execute a Memorandum of Understanding with the cities of Kansas City, Missouri, and Lee=s Summit, Missouri, in connection with improvements to Lee=s Summit Road between 40 Highway and Anderson Drive, Project No. 3122; and,

WHEREAS, by Resolution 17197, dated March 8, 2010, the Legislature did authorize an agreement for engineering design services in connection with the improvements to Lee=s Summit Road; and,

WHEREAS, this Project is scheduled for construction during 2014 and 2015; and,

WHEREAS, Missouri Gas Energy (MGE) has an existing eight-inch high pressure main and an existing sixteen-inch high pressure transmission line along Lee's Summit Road in private utility easements, which are in conflict with the proposed roadway improvements; and,

WHEREAS, the estimated cost for MGE to relocate its utility lines is $1,179,275.00; and,

WHEREAS, the Director of Public Works recommends the execution of the attached agreement with MGE for the relocation of gas lines related to the Lee=s Summit Road between 40 Highway and Anderson Drive, Project No. 3122; and,

WHEREAS, the Director also recommends the use of Kansas City CURS bond funds to cover the cost of this relocation project; and,

WHEREAS, the execution of the attached agreement is in the best interest of the health, safety, and welfare of the citizens of Jackson County, now therefore...
