AN ORDINANCE transferring $50,000.00 within and appropriating $8,020.00 from the fund balance of the 2011 Health Fund, and awarding a contract on Bid No. 03-2011, for the Animal Shelter Facility Project, No. 3119, to R.L. Philips Construction, Inc., of Raymore, MO, at a cost to the County not to exceed $4,849,500.00, and authorizing the Director of Public Works to approve line item adjustments under this contract at no additional cost to the County.

Body
WHEREAS, by Resolution 16925, dated June 8, 2009, the Legislature did authorize the County Executive to execute an Intergovernmental Cooperative Agreement with the City of Independence, Missouri, for the construction of a shared animal shelter facility; and,
WHEREAS, by Ordinance 4222, dated August 2, 2010, the Legislature did authorize the award of a contract for the animal shelter site preparation, and that work is now complete; and,
WHEREAS, the Director of Public Works has solicited formal written bids on Bid No. PW 03-2011 for the construction of the Animal Shelter Facility Project, No. 3119; and,
WHEREAS, he has received eight bids thereon, with the three lowest bids as follows:

Straub Construction $5,128,000.00
Shawnee, KS
Vanum Construction Co., Inc. $5,311,000.00
Kansas City, KS
and,
WHEREAS, the bid package included a list of deducts the County could apply if the bids were higher than the budget and, by applying certain deductions, the low bid was reduced by $192,500.00; and,
WHEREAS, the Director of Public Works recommends that the contract be awarded to R. L. Philips Construction, Inc., of Raymore, MO, at a cost to the County not to exceed $4,849,500.00, for the reason that it has submitted the lowest and best bid; ...
