Body
WHEREAS, Overland Property Group, LLC, of Overland Park, Kansas, has applied for a building permit and all other necessary approvals form the City of Independence, Missouri for the construction of an elderly housing development commonly known as the Gardens of Jackson Creek; and,

WHEREAS, Overland Property Group, LLC, has requested a permanent easement across a portion of the Little Blue Trace Park adjacent to the proposed development for certain park improvements that facilitate this construction project; and,

WHEREAS, Overland Property Group, LLC will pay the county a fee of $2,000.00 plus $0.40 per square foot; and,

WHEREAS, the execution of the attached easement is in the best interest of the health, welfare, and safety of the citizens of Jackson County; now therefore,

BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the attached Easement Agreement is hereby approved and that the County Executive is hereby authorized to execute on behalf of the County the Agreement and any other documents necessary to give effect to this Resolution.

Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
