Body
WHEREAS, by Resolution 16765, dated November 24, 2008, the County did enter into a Cooperative Agreement for Environmental Remediation with the City of Independence, MO, whereunder the County agreed to provide the City the sum of $175,000 to be used by the City to remediate certain environmental hazards which then existed at the City's property located at 315 N. Main in the City of Independence; and,

WHEREAS, the Agreement granted to the County the option to purchase the property from the City upon the completion of the remediation for the payment of $1.00 and other valuable consideration; and,

WHEREAS, the City has advised the County that the environmental remediation of the property has been completed; and,

WHEREAS, the County has determined to exercise its purchase option granted under the Cooperative Agreement, and will do so upon the City's execution of an Environmental Covenant with the Missouri Department of Natural Resources and the filing of said covenant with the County Recorder of Deeds; and,

WHEREAS, the County staff has reviewed and approved the attached Special Warranty Deed by which the City has proposed to convey the property to the County; and,

WHEREAS, the exercise of the purchase option and acceptance of the conveyance are in the best interest of the health, welfare, and safety of the citizens of Jackson County; now therefore,
