Body
WHEREAS, by Resolution 17232, dated March 29, 2010, the Legislature did authorize an Intergovernmental Cooperative Agreement with the City of Independence for the use of certain County property for civic events to be held on or near the Independence Square, including Santa-Cali-Gon Days; and,
 
WHEREAS, subsequent dealings among interested parties have revealed that the Independence Chamber of Commerce, and not the City of Independence itself, is the entity responsible for conducting Santa-Cali-Gon Days, and this is the entity that has requested the use of the County parking lots including, specifically, the parking lot located at Kansas and Osage; and,
 
WHEREAS, the Director of Public Works recommends a Cooperative Agreement with the Independence Chamber of Commerce with specific provisions including certificate of liability insurance, restoration of the parking lot to its original condition (free of debris and in good repair), and written confirmation for County employee use of other area parking lots adjacent to the First Christian Church and Masonic Temple; and,
 
WHEREAS, the proposed agreement is in the best interest, health, safety and welfare of the citizens of Jackson County; now therefore,
 
BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that Resolution 17232 dated March 29, 2010, be rescinded and that the County Executive is hereby authorized to execute a Cooperative Agreement with the Independence Chamber of Commerce, as recommended by the Director of Public Works,  at no cost to the County, in a form to be approved by the County Counselor.
 
 
Enacted and Approved
Effective Date:  This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
