Body
WHEREAS, by Resolution 15511, dated June 6, 2005, the Legislature did authorize the execution of a successor Memorandum of Understanding (MOU) with Local Union 42 of the International Association of Fire Fighters to govern terms and conditions of certain employees within the office of the Prosecuting Attorney; and,

WHEREAS, one of the negotiated terms of the MOU was a change to the composition of the Jackson County Pension Plan Administration Committee; and,

WHEREAS, by Ordinance 3696, effective November 3, 2005, the Legislature did modify the composition of this committee, as set out in section 1540., Jackson County Code, in an attempt to comply with the MOU; and,

WHEREAS, the union has now suggested that the revision enacted by Ordinance 3696 is not completely consistent with the applicable provision of the MOU; and,

WHEREAS, the amendment embodied in this Ordinance will fully implement the applicable provision of the MOU, and is in the best interests of the health, welfare, and safety of the citizens of Jackson County; now therefore,

BE IT ORDAINED by the County Legislature of Jackson County, Missouri, as follows:

Section A. Enacting Clause. Section 1540., Jackson County Code, 1984, is hereby repealed and one new section enacted in lieu thereof, to be known as section 1540., to read as follows:


1540. Pension Plan Administration Committee, Composition.


The Employer by action of the County Legislature and the County Executive shall appoint a Committee to be known as the "Pension Plan Administration Committee" to administer the Plan and to keep records of individual Member benefits. The composition and membership of the Pension Plan Administration Committee shall be established as follows:

(i) the Manager of Finance, as Chairman;

(ii) the Director of Personnel, as Secretary;

(iii) an active Member of the Plan who is an employee of the Circuit Court, to be appointed from time to time by the Presiding Judge of the Circuit Court;

(iv) two (2) active Members of the Plan to be appointed from time to time by the County Legislature, not more than one member from any one department;


(v) four (4) independent business executives to be appointed from time to time by the County Executive subject to disapproval of the County Legislature.

(vi) one (1) member of the Local 42 bargaining unit within the Office of the Prosecuting Attorney, selected by the Prosecuting Attorney of Jackson County.

(vii) one (1) [member of the Local 42 bargaining unit within the Office of the Prosecuting Attorney] person selected by the President of Local 42 of the International Association of Firefighters.


1540.1 The Employer will notify the Actuary and the Trustee of the names of the members of the Pension Plan Administration Committee and of any changes in the membership of the Committee that may take place from time to time.

Effective Date: This Ordinance shall be effective immediately upon its signature by the County Executive.
