AN ORDINANCE granting a conditional use permit (CUP) in District A (Agricultural) for a period of three (3) years to operate a horse boarding, training and riding facility on a 35 + acre tract .

Body
BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:

Section 1. A conditional use permit is hereby granted for a period of three (3) years to operate a horse boarding, training and riding facility as to a parcel of land approximately1/4 mile east of Perdue Road on the south side of Colbern Road legally described as follows:
Description: Commencing at the northeast corner of southeast quarter of Section 28, Township 48, Range 30 then S 01 DEG 58 MIN 49 SEC West 1,062.84 feet; then N 88 DEG 21 MIN 00 SEC W 1,313.65 feet; then N 01 DEG 53 MIN 48 SEC E 1,057.41 feet; then S 88 DEG 35 MIN 10 SEC East 1,315.23 feet to Point of Beginning, except part in road, aka 30509 Colbern Road.


Section 2. The conditional use permit granted by this Ordinance is subject to the following conditions:
1. The number of horses boarded shall be limited to no more than 4 at any one time.

2. No horse shows, commercial concession stands or tack store shall be provided on the premises.

3. All outdoor lighting shall be turned off no later than 9:00 p.m. each night.

4. The Applicant shall within six (6) months from the approval date of this ordinance construct and/or repair the fences as illustrated on Exhibit A. All equestrian classes shall be conducted within fenced areas. The applicant shall maintain these fences.
5. The applicant shall only provide equestrian classes to children between the ages of 7 and 17 and individuals with mental and physical disabilities in compliance with IRS Code 501 c3.
