Body
BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:

Section 1. A conditional use permit is hereby granted for a period of twenty-five (25) years to continue operating a 299-ft. microwave communications tower as to a 1.3 + acre tract described as follows:
Description: The 1.3 ± acres is approximately ½ mile east of Johnson Road on the north side of Twiehaus Road and on the east side of existing substation No. 1,and specifically described as:

Part of the east half of Section 1, Township 50, Range 30 in Jackson County, Missouri aka 34900 E. Twiehaus Road.



Section 2. The Legislature, pursuant to the application of Aquila, Inc. (CU-2004-176), requesting approval embodied in this ordinance and with notice that the Jackson County Plan Commission unanimously recommended approval of this application in a public hearing on February 19, 2004, does adopt this ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.

Enacted and Approved
Effective Date: This Ordinance shall be effective immediately upon its signature by the County Executive.
