BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:
Section 1. A conditional use permit is hereby granted for a period of ninety-nine (99) years to construct an electric transmission line as to a 3.6 + acre tract of land described as follows:
Description: A 3.6 ± acre easement approximately 1/4 of a mile east of Buckner Tarsney Road on the south side of R.D. Mize Road and specifically described as:
The west 100 feet of the Northwest 1/4 of the Southeast 1/4 of Section 2, Township 48, Range 30, Jackson County, Missouri, except that part in public right of way, containing 3.03 acres. And also; a tract of land 60 feet in width, the centerline of which is described as follows: Beginning on the North line of the Southwest Quarter of the Southeast Quarter of Section 2, Township 48, Range 30, Jackson County, Missouri, at a point sixty (60) feet East of the West line of said Quarter, Quarter Section; Thence South parallel with said West line a distance of 160 feet; Thence East parallel with the North line of said Quarter, Quarter Section a distance of 260 feet to the Point of Termination, containing .58 acre, more or less.
Section 2. The Legislature, pursuant to the application of Aquila, Inc. (CU-2003-170), requesting approval embodied in this ordinance and with notice that the Jackson County Plan Commission unanimously recommended disapproval of this application in a public hearing on September 18, 2003, does adopt this ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.
