Body
WHEREAS, the County has heretofore entered into a Service Contract with the Little Blue Valley Sewer District (the "District") providing, among other things, for the treatment by the District of sewage contributed to it by the County in consideration of the payment of a charge to the District by the County; and,

WHEREAS, the District operates a sewer system (the "System") for the primary benefit of the customers within the District including the County ("Customers") and for others connected to the District's System; and,

WHEREAS, District has undertaken to review the existing infrastructure of the System and has approved a Facility Plan for improvement, expansion, rehabilitation, and replacement of the System; and,

WHEREAS, the implementation of the Facility Plan necessitates consideration of appropriate methods of financing such Plan, including the issuance of new bonds, notes, or alternative sources of financing; and,

WHEREAS, the Customers of the District, including the County, have participated in organized workshops and public meetings to review the proposed Facility Plan and proposed financing plans; and,

WHEREAS, certain variations exist among the existing service agreements between the District and its Customers attributable to the conditions which existed at the time a Customer's service agreement was entered into; and,

WHEREAS, it is necessary to modify existing provisions in the various service agreements with all Customers in order to resolve differences within individual service agreements to facilitate the financing of the improvement, rehabilitation and replacement of the System pursuant to th...
