Body
WHEREAS, the State of Missouri, pursuant to §476.001, RSMo, has established that an efficient, well operating, and productive judiciary is essential to the preservation of the people's liberty and prosperity; and,
WHEREAS, Jackson County, pursuant to §221.040 RSMo has the duty to receive all persons who have been committed to its detention center; and,
WHEREAS, the Missouri Department of Corrections has no statutory obligation to provide any pre-trial services but does have experience performing bond evaluations and monitoring persons on electronic detention; and,
WHEREAS, the Missouri Department of Corrections and the County acknowledge that a cooperative effort is necessary to ensure that pretrial services meet the public safety requirements of the citizens of Jackson County and commit their respective agencies in support of this endeavor; and,
WHEREAS, the attached Memorandum of Understanding provides a suitable mechanism by which to implement the mutual goals of the parties regarding pretrial services; now therefore,
BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the County Executive be and hereby is authorized to execute the attached Memorandum of Understanding with the Missouri Department of Corrections.
Enacted and Approved
Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
