Body
WHEREAS, American Portable Telecom Kansas City, Inc. (APT), has proposed to construct a 150-ft. lattice communications tower adjacent to the Sheriff's Department's headquarters building in Fleming Park; and,

WHEREAS, under APT's proposal, APT would construct the tower at its own expense and the tower would become County property suitable for use by the Sheriff's Department in connection with its enhanced communications system; and,

WHEREAS, APT would retain the right to use the tower, rent free, for five years, for use in its wireless personal communications system network; and,

WHEREAS, thereafter, APT would have three options to renew its use of the tower, for five years each, at rentals commencing at the rate of $500 per month; and,

WHEREAS, in connection with this construction, APT will dismantle the department's existing 150-ft. tower, which will remain the property of the County, and will deliver that tower to such location as the County may direct; and,

WHEREAS, the new tower will accommodate the co-location of the facilities and equipment of another wireless communications provider, and any revenue to be derived from such co-location will be the County's; and,

WHEREAS, the Sheriff recommends the acceptance of APT's proposal; and,

WHEREAS, the acceptance of APT's proposal is in the best interests of the health, welfare and safety of the citizens of Jackson County; and,

WHEREAS, the attached Site Agreement provides a suitable mechanism for the implementation of this proposal; now therefore,
