Body
WHEREAS, in response to the ruling of the Missouri Court of Appeals Eastern District in the case of Outcom, Inc. v. City of Lake St. Louis, No. 69504 (December 24, 1996), the Director of Public Works has recommended an amendment to the off-premise sign standards of the Unified Development Code; and,

WHEREAS, under the recommendation, the County would no longer independently regulate signs located within 660 feet of an interstate or state primary highway; and,

WHEREAS, instead, the Director will issue an administrative permit to the applicant for any sign so located which meets the state law requirements of 226.540, RSMo; and,

WHEREAS, at its regular meeting of August 21, 1997, the Plan Commission recommended this amendment; and,

WHEREAS, this amendment is in the best interests of the health, welfare, and safety of the citizens of Jackson County; now therefore,

BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:

Section A. Enacting Clause. Section 24007., Jackson County Code, 1984, is hereby amended by the addition of a new subsection 24007. 2. e. 2, to read as follows, with existing subsection 24007. 2. e. 2. to be renumbered accordingly:

Section 24007. 2. e. 2. An off-premise sign which is located within six hundred sixty feet of the nearest edge of the right-of-way of any Interstate Highway or State Non-freeway Primary Highway, and which meets the standards set forth in section 226.540, RSMo, will be granted an administrative permit pursuant to sections 24007.2.a and 24003.25 upon the presentation to the Director of a valid permit issued by the State of Missouri Highways and Transportation Commission.
