Body
WHEREAS, many County offices and departments routinely receive overpayments for fees, taxes, and costs due the County; and,

WHEREAS, since it costs $8.00 in staff time and resources to issue a check, the processing refunds of small overpayments causes a significant burden on County staff and resources; and,

WHEREAS, for example, between May 19 and May 23, 2006, the Collection Department issued sixty-seven refund checks of ten dollars or less, at a cost to the County in excess of $500.00; and,

WHEREAS, section 9051.15 of the County Code authorizes the Recorder of Deeds to retain a fee not to exceed $10.00 for any overpayment, thereby significantly reducing the number of refunds that department is required to process; and,

WHEREAS, it is appropriate to extend this overpayment fee to other departments and offices of County government that accept payments, in order to allow those departments and offices to enjoy the same efficiencies; now therefore,

BE IT ORDAINED by the County Legislature of Jackson County, Missouri, as follows:

Section A. Enacting Clause.

Section 554., Jackson County Code, 1984, is hereby enacted to read as follows:

554. Overpayments of Fees, Taxes, and Costs.
The county will retain an overpayment processing fee not to exceed ten dollars ($10.00) for any overpayment of any fee, tax, or cost specified in this code or required by law. The remainder of any overpayment, if in excess of ten dollars ($10.00), will be refunded in the ordinary course of county business. No overpayment of ten dollars or less will result in a refund unless the payor makes a request in writing within thirty (30) days of the transaction, and provides a receipt or documen...
